Product Compliance And Certification For Mobile Phone In The Eu
A mobile phone offered in the EU is not cleared by a single ‘CE certificate’. Its manufacturer must resolve a stack of product, radio, chemical, sustainability and information requirements. Start with the exact hardware model, its software functions, charging method and who first places it on the EU market; do not infer approval from an overseas certificate, a tested radio module or a CE logo alone.
Classify the actual handset before choosing a route
Classify against the definitions in Regulation (EU) 2023/1670 and Delegated Regulation (EU) 2023/1669, not the sales name. A voice-only feature phone, a smartphone that runs third-party applications, a cordless landline handset and a roll-up-screen product do not necessarily have the same sustainability duties. The mobile phone's installed radio functions remain subject to a separate RED analysis.
- Document cellular and satellite connectivity, SIM/eSIM, Wi-Fi, Bluetooth, NFC, wireless charging, antennas, supported bands and every marketed operating mode.
- Record whether wired charging is possible, the USB-C port and USB Power Delivery behaviour, maximum charging power and whether a charger is supplied.
- Identify operating system, internet and personal-data functions, payment or digital-value capabilities, update policy and third-party applications.
- Fix the EU launch date, model/variant identifiers, manufacturer and importer, countries of sale, battery configuration and packaging contents.
For the energy label, “smartphone” has a narrower statutory definition than a device with apps: it also requires an integrated touch screen with a viewable diagonal of at least 4.0 but less than 7.0 inches; special rules cover foldable or multiple displays. Document the display measurements and check the rollable-display and high-security exemptions rather than assuming every Android-style handset is labelled.
Check who is the legal manufacturer before accepting an OEM dossier. Under RED Article 14, an importer or distributor that markets the phone under its own name or trade mark, or changes radio equipment already placed on the market in a way that may affect RED conformity, assumes the manufacturer’s RED obligations. A factory test report does not transfer those obligations.
EU mobile-phone compliance decision matrix
Use the matrix as a screening tool: ‘usually’ means assess the stated legal scope and exceptions for the precise device, not an automatic certificate or universal exemption.
| Regulatory layer | Classification trigger | Release evidence or action |
|---|---|---|
| RED 2014/53/EU | Phone transmits/receives radio waves for radio communication or radiodetermination. | RF/spectrum, health including RF exposure, EMC and electrical safety evaluation; technical file, EU declaration of conformity and CE marking. |
| RED cyber 2022/30 | Internet-connected radio equipment; personal/traffic/location data; monetary-transfer functions determine points (d), (e), (f). | Threat model and EN 18031 evidence; check restricted harmonisation and whether notified-body assessment is required. |
| Common charger 2022/2380 | Covered handheld mobile phone rechargeable by wired charging; rules apply from 28 Dec 2024. | USB-C/charging interoperability evidence plus prescribed charger pictogram and charging-information label. |
| Ecodesign 2023/1670 | Smartphones and other defined mobile phones in scope since 20 Jun 2025; check exclusions. | Durability, battery and repairability records; spare-parts/repair and operating-system support commitments. |
| Energy label 2023/1669 | Smartphone within scope, not merely any feature phone; since 20 Jun 2025. | Model registration in EPREL before market placement, verified label data, product sheet and dealer/online display assets. |
| RoHS / REACH | Electronics containing homogeneous materials, components and possible substances of concern. | Material declarations and restricted-substance evidence; assess REACH information/SCIP duties when thresholds and conditions apply. |
| WEEE / battery / packaging | Electrical device plus portable battery and sales/transport packaging. | Crossed-bin and collection information; check relevant national producer registrations, batteries rules and packaging duties. |
| Privacy / connectivity | Personal-data processing or network/operator services alongside the device. | Separately assess GDPR/ePrivacy roles, security and any carrier-specific interoperability criteria; none replaces product CE. |
| CRA transition | Digital-element product with reporting duties from 11 Sep 2026; main CRA regime from 11 Dec 2027. | Incident/vulnerability reporting process now; plan 2027 security evidence and recheck releases across the transition. |
Choose the RED conformity route correctly
RED Article 3(1) covers health/safety (including the Low Voltage Directive safety objectives without voltage limits) and EMC; Article 3(2) covers spectrum. Those requirements are assessed through RED for the radio equipment, not by assuming that separate EMC and Low Voltage Directive approvals replace RED. RoHS remains a separate applicable CE-marking regime.
Under Article 17, internal production control is a possible route for Article 3(1). For Article 3(2) and applicable Article 3(3) obligations, internal production control is an option only when the relevant harmonised standards whose references appear in the EU Official Journal are applied in full to cover the relevant requirements. Otherwise an EU-type examination plus conformity-to-type route, or full quality assurance involving a notified body, is required. A laboratory test report is not automatically an EU-type examination certificate.
From 1 August 2025 the applicable RED cyber requirements under Delegated Regulation 2022/30 include network, privacy and anti-fraud protections. EN 18031-1/-2/-3 references were published with restrictions by Decision 2025/138: check whether the exact design falls outside the presumption of conformity. Regulation 2026/339 repeals Delegated Regulation 2022/30 only from 11 December 2027; the CRA then applies in full. CRA Article 14 reporting already applies from 11 September 2026, including to relevant older marketed products.
EN 18031 is a set of voluntary harmonised standards, not itself the legal obligation. The Official Journal restrictions include configurations where users may operate without setting a password and, under EN 18031-3, a secure-update assessment criterion. If the harmonised standards do not fully cover an applicable Article 3(2) or 3(3) requirement, use the Article 17 notified-body route for that requirement rather than treating a test report as sufficient.
For a phone enabling transfers of money, monetary value or virtual currency, specifically screen RED Article 3(3)(f): Decision 2025/138 excludes EN 18031-3:2024 clause 6.3.2.4 assessment criteria from the presumption of conformity for that requirement. Do not choose internal production control solely on that clause; document the Article 17 notified-body assessment decision and any other fully applicable Official Journal-cited standard.
Product-specific evidence package to request before testing
- Model/variant matrix: hardware revisions, modem and RF modules, antennas, frequency bands, SAR/RF exposure configurations, countries and software builds.
- RED assessment plan: intended/foreseeable use, RF/EMC/safety and cybersecurity standards edition, OJ publication/restriction checks, test reports and notified-body decision rationale.
- Cybersecurity file: architecture, personal-data flows, payment functions, threat assessment, authentication, secure-update process and vulnerability-handling contacts.
- Charging file: USB-C mechanical/electrical verification, USB Power Delivery where applicable, wired versus wireless modes and packaging pictogram/label mock-ups.
- Sustainability file: battery-cycle/endurance and drop/ingress results, repairability calculations, disassembly instructions, parts and OS-update commitments, EPREL values.
- Substance and end-of-life file: RoHS BOM/material declarations, REACH screening, battery specifications, WEEE marking and national EPR/packaging arrangements.
- Commercial accountability file: responsible EU economic operator under Regulation 2019/1020 Article 4, importer identity, trade name, traceable batch/model IDs and supply-chain mandates.
- Market-ready file: EU DoC (or RED simplified DoC with URL), CE and other correct symbols, national-language safety information, RF bands/max power and distance-sale label assets.
Launch sequence and the point at which each task blocks sale
- Freeze the handset SKU and variants; document product definitions and legal applicability, including special exclusions. Do not extrapolate one test to changed antennas or firmware.
- Choose RED harmonised-standard and notified-body route, test the worst-case configurations, and close radio, electrical, cyber and chemical nonconformities.
- Close eco-design obligations, prepare the smartphone energy label and register the covered model in EPREL before its first EU market placement; give online/retail partners the required assets.
- Confirm the EU economic operator and country-specific WEEE, batteries and packaging arrangements; produce correct device, packaging and online information before making offers.
- Release the EU declarations and technical documentation, start service/spare-part and cybersecurity reporting workflows, and retain change control for hardware, software and suppliers.
Handset edge cases: feature phones, charging, modems and future rules
A feature phone can be subject to RED, common-charger (if wired), ecodesign and end-of-life duties without necessarily requiring the smartphone energy label. A wireless-only charging phone needs a specific check of the wired-charging trigger rather than a blanket USB-C assertion. A phone using a pre-certified modem still requires finished-product assessment of its antennas, exposure, EMC, software and applicable other regimes. The battery removal rule in Batteries Regulation Article 11 starts on 18 February 2027, with statutory derogations and interaction with product-specific repair rules; do not assume it is already an unconditional 2026 handset requirement. The Packaging Regulation 2025/40 generally applies from 12 August 2026, but its harmonised material label is scheduled later, not automatically required in 2026.
Ecodesign is also a conformity-documentation gate, not merely a repair checklist: for covered phones the preserved Article 5 of Directive 2009/125/EC (see Regulation 2024/1781, Article 79) requires a conformity declaration referencing implementing Regulation 2023/1670 and supporting technical documentation alongside CE marking. A combined declaration can cover applicable CE legislation. Battery-replacement and repair duties already arise under Regulation 2023/1670 from 20 June 2025; the separate Batteries Regulation Article 11 starts on 18 February 2027 subject to its conditions and exceptions.
EU scope is not foreign market approval
A finished EU route does not itself provide FCC, UK or Chinese authorisation. For separate market-entry decisions, compare the respective product route maps:

Frequently asked questions
Can I sell a CE-marked imported phone without an EU notified body?
Sometimes the RED manufacturer may use internal production control, but only if the Article 17 conditions for the relevant requirements are met. Verify OJ harmonised standards and cybersecurity restrictions, and identify the EU economic operator; CE artwork or supplier reports do not decide the route.
Does a basic keypad phone need an EPREL smartphone label?
Not solely because it is a mobile phone. Test its functionality against the smartphone definition and the energy-labelling Regulation scope; RED, ecodesign and relevant charging rules may still apply.
Does USB-C remain mandatory if charging is wireless?
The common-charger technical requirement for this category is triggered by wired recharging capability. Assess the actual product and packaging under Directive 2022/2380; a model capable of wired charging cannot avoid the rule merely because wireless charging is promoted.
What happens if we launch before 11 December 2027 but keep selling afterwards?
Do not confuse market placement dates, stock already placed on the market and later model changes. RED cybersecurity applies to relevant 2025–2027 placements; CRA reporting operates from September 2026 and its main framework from December 2027. Reassess substantially modified or newly placed products separately.
Can the modem supplier’s CE certificate cover our new phone?
No blanket transfer. Module data may support the technical file, but the finished radio equipment and its antenna, power, RF exposure, enclosure, firmware and added functions must be assessed against applicable requirements.
