Service-Specific Terms: Product Regulatory Support
How the scope of product-regulatory assistance, third-party specialists, evidence and fees is agreed.
1. Individual scope and market
A product assessment must identify its intended use, users, composition, design, claims, classification, manufacturing role and each target jurisdiction. An initial query may be insufficient to determine whether a conformity assessment, testing, notification, registration or authorisation is necessary.
2. Regulatory route analysis
We may map applicable legislation, competent regulators and possible procedures based on the supplied facts. An assessment distinguishes legal requirements from harmonised standards, recommendations and voluntary schemes; assumptions and unresolved questions must be recorded in the deliverable.
3. EU conformity and CE marking
Not every product requires CE marking; where it is required, the applicable EU legislation and assessment module depend on the product. A notified body is involved only where the relevant legal framework requires it. CE marking is not a universal certificate issued by a consultant.
4. Technical documentation and evidence
Work may address risk assessments, product descriptions, labelling, instructions, test reports, declarations of conformity and supply-chain evidence. The client is responsible for genuine and complete information, current versions, traceability and correcting inconsistencies identified during review.
5. Testing and laboratory coordination
We can help prepare test briefs and coordinate with laboratories. The laboratory determines its scope of accreditation, methods, samples, prices, conditions and issued reports. Tests may fail or require product changes; a laboratory quotation is not a regulatory approval.
6. Medical devices, cosmetics and specialist products
Medical devices, in vitro diagnostics, cosmetics, food-contact materials, chemicals, batteries, toys, radio equipment and machinery can trigger distinct frameworks and country-specific responsibilities. We cannot treat a cosmetic notification as a certification or a notified-body certificate as a substitute for every market-entry obligation.
7. Economic operators and representatives
Manufacturer, importer, distributor, authorised representative and responsible-person obligations are legally distinct. A mandate, territorial presence or local representative cannot be assumed from a generic service description. Any representation or regulatory submission must be expressly agreed and legally permitted.
8. Cross-border market entry
Requirements in the EU, UK, US, Canada, Gulf states, Asia and other destinations may differ considerably. CE marking does not automatically provide lawful access outside its applicable framework. Translations, local licences, import controls, labelling and registrations may need separate analysis.
9. Scope changes and timetable
Additional product variants, intended uses or target markets may require a new classification or testing plan. Published time estimates are not binding promises, especially when a third-party laboratory, agency or regulator controls the schedule. Material changes must be documented and priced before execution.
10. Third-party expenses and ownership
Laboratory fees, official charges, certificates, translations, couriers and external professional work are separate unless included in the written offer. Ownership of test results, dossiers and client materials depends on intellectual-property rights and the signed engagement; client originals remain subject to the agreed return procedure.
11. Client cooperation and confidentiality
The client must disclose known safety incidents, adverse findings, recalls, changes, authority objections and material test failures where relevant. Confidential technical material should be transmitted by an agreed secure channel rather than an initial public form. External specialists receive only what is needed and permitted.
12. Outcomes and completion
A deliverable may be a written analysis, dossier checklist, completed coordination step or submitted package, as expressly agreed. Only the competent decision-maker can approve, certify or register a product. Service completion and any cancellation or refund are governed by the individual offer, mandatory law and Refund Policy. Revised 16 October 2026.
Regulatory responsibilities
Product classification, applicable rules and obligations depend on intended use, technical characteristics and the economic operator’s legal role. We do not replace the functions or independent decisions of regulators, testing laboratories, notified bodies or certification authorities.
Documents and information
Clients must provide accurate product specifications, intended use, manufacturer information, available test reports, labels and relevant correspondence. Additional samples, translations or technical evidence may be needed; incomplete information may delay work.
Third parties and costs
Testing fees, government charges, certification-body fees, translation, courier and specialist-provider expenses are separate unless expressly included in the agreed scope. No regulatory approval, deadline or outcome is guaranteed.
Changes and completion
Regulations and official procedures can change. Material changes in the product or target market require reassessment. Deliverables, handover, cancellation and responsibilities follow the specific engagement and mandatory law.
