South Korea Mfds Medical Device Registration Service For IVD Device

Scope and evidence must be confirmed before any paid tests or filings.

What an IVD filing service actually submits

An in-vitro diagnostic (IVD) assay, reagent, instrument or associated product is not filed in Korea simply as a generic medical device. The Act on In Vitro Diagnostic Medical Devices, its enforcement rules and MFDS notices govern the product route. The task is to align the actual intended use, risk class, Korean applicant, product scope and supporting data before an application is sent.

This is a filing-execution guide, not a promise that an overseas certificate, a CE mark or an FDA decision automatically authorises sales in Korea. The outcome depends on the Korean category and the authority’s review.

IVD route selection: NIDS certification or MFDS approval

The four IVD risk classes do not map to a single approval office. The table is a routing screen; confirm the current Korean classification and listed product/category eligibility before claiming a notification or certification route.

IVD classification / gateFiling route and recipientWhat to verify before filing
Class I, eligible product/categoryManufacture/import notification handled by the National Institute of Medical Device Safety Information (NIDS).Confirm the prescribed IVD item code and whether the filing is by product or listed product category; do not file a higher-route device as Class I.
Class IISpecified Class II products may qualify for NIDS certification; other Class II products, including non-equivalent products, require MFDS approval.Test whether category certification is expressly listed and whether intended use, operating principle and performance support the equivalence claim.
Class III or IVProduct-specific MFDS approval, with the supporting technical and clinical-performance materials applicable to the product.Verify risk class, claimed clinical use and whether review of clinical-performance evidence applies.

Crucial distinction: a Class II IVD is not automatically certified. Article 5 of the enforcement rules, amended on 18 September 2026, differentiates listed Class II certifications from Class II products requiring individual approval.

Korean IVD applicant and overseas manufacturer: who does what

PartyFiling responsibility / deliverable
Korean importer/applicantFor imports, obtains the import-business permit and makes the product notification, certification or approval filing through the applicable body. An initial import-business permit application must be paired with at least one product filing.
Overseas legal manufacturerSupplies controlled versions of intended use, design, analytical and clinical performance, manufacturing-site details, quality evidence and supporting test reports; verifies that claims match the labelled device.
Filing coordinator/service providerBuilds a Korean submission index, checks consistency and evidence gaps, manages deficiency responses and logs submission receipts. A consultant is not automatically the statutory permit holder.

Set out who holds the Korean permission, who controls the regulator account, who may authorise dossier changes and how access and records will be transferred if a distributor relationship ends. This is a contractual control checklist, not an additional MFDS permit category.

IVD dossier intake: the seven evidence bundles

Use one version-controlled register per assay / instrument / intended-use configuration. The following is a preparation checklist; the actual attachment set depends on the authorised route and the applicable IVD technical-document rules.

  • Identity and use: Product, model, IVD item code, intended population and user, specimen type, test purpose, place of use and whether self-testing is claimed.
  • Principle and composition: Operating principle, analyte/target, reagents and critical raw materials, instrument compatibility, controls, calibrators and variants.
  • Analytical performance: Sensitivity, specificity or relevant analytical measures, precision, reproducibility, interference, cross-reactivity, detection limits and stability as applicable.
  • Clinical performance: Clinical-performance plan/results and comparator logic where required; explain the evidence linking results to each diagnostic claim.
  • Manufacturing and quality: Manufacturing sites, process overview, quality-system and inspection evidence applicable to the product, and test-outsourcing contracts where used.
  • Labels and Korean submission: Current instructions for use, warnings, storage, shelf life, claimed performance, Korean application fields and translation/reconciliation list.
  • Prior permissions and changes: Any Korean predecessor permission, exact-product evidence, manufacturing-site identity and history of revisions; foreign approvals are context, not automatic substitutions.

IVD import forms, submission and authority responses

Do not open the electronic case until the filing entity, device identity and route are coherent. A practical sequence is:

For imported IVDs, Article 26 of the IVD Enforcement Rules specifies Form 3 for an MFDS approval application, Form 5 for a NIDS certification application and Form 7 for a NIDS notification. Select the form by the confirmed route; these import forms are not a substitute for manufacturer-side forms.

  1. Freeze the intended-use statement, assay or instrument configuration, Korean item code and provisional risk class; resolve any ambiguity before choosing an authority.
  2. Confirm the licensed Korean applicant/importer and whether an import-business permit must be filed concurrently with the first IVD product.
  3. Map each mandatory form field to a controlled evidence file, classify technical or clinical-performance evidence and identify any applicable quality-system review.
  4. Prepare the correct notification, certification or approval forms, Korean-language filing data and supporting attachments; check the selected electronic procedure.
  5. Submit through the MFDS medical-device electronic civil petition system where supported, retaining the receipt, case identifier and complete submitted version.
  6. Answer authority/NIDS requests with a dated issue log, revised documents and a clear cross-reference; do not silently change the intended use or claim scope.
  7. Check that the issued notification certificate, certification or approval identifies the intended product/models and applicant correctly before commercial release.

2026 IVD self-test usability, evidence waivers and review-result substitution

Home/self-testing usability: MFDS Notice 2026-58, effective 10 August 2026, added usability evidence provisions for self-testing IVD reagents and instruments. For a consumer test, explicitly screen those provisions and the accepted evidence types rather than filing a professional-use package unchanged.

A separate exemption check is essential: Article 26 of the MFDS filing-and-review Notice, with Schedules 7 and 8, allows omission of usability evidence in specified cases; Article 27 defines acceptable evidence. Record why an exemption does or does not apply. This Notice Article 26 is different from Article 26 of the IVD Enforcement Rules on import-file attachments.

Identical-product documents: enforcement rule Article 26 allows omission of specified technical/clinical attachments only where an identical product from the identical manufacturer, country and manufacturing site is demonstrated as prescribed. It is not a blanket exemption for a similar assay, a shared brand or an overseas authorisation.

A separate documentary alternative exists for an import approval: under Enforcement Rule Article 26(1)(3), a qualifying technical-document and clinical-performance review-result notice issued within the preceding two years may be submitted instead of the corresponding materials. Confirm the notice date, its product scope and eligibility; this is not an automatic waiver of product approval.

Software, combinations and study evidence: an IVD with software, a home-use workflow or novel clinical claims may need a narrower regulatory assessment. Do not assert that every product needs a new Korean clinical study; determine which technical and clinical-performance evidence the applicable route actually demands.

IVD filing defects and targeted corrections

Delay / rejection triggerExecution-level correction
Wrong Class II certification assumptionDocument the Article 5 category eligibility and equivalence comparison before selecting NIDS instead of MFDS.
Manufacturer, model or claim differs across documentsReconcile the application form, device labels, performance reports and supplier/site records against one signed product-identity sheet.
Analytical or clinical results do not support the exact claimAdd a claim-to-study matrix showing specimen, population, cut-off, comparator and performance endpoint; qualify unsupported claims.
Foreign authorisation is treated as Korean clearanceUse foreign decisions as reference evidence only; establish the Korean filing and issuance status separately.
Self-test usability or quality documents omittedScreen the 2026 self-testing rules and the product-specific quality/outsourcing requirements; obtain the missing evidence before submission.

After the IVD decision: changes and filing obligations

After the decision, keep the granted product scope aligned with marketed models, Korean-language materials and manufacturing information. Material changes to site, design, raw materials, performance, intended use or instructions may require an amended permission, notification or report under the applicable change category; the precise route must be checked before implementation.

Assign a local owner for complaint escalation, safety reporting, traceability/UDI obligations where applicable, quality records and renewals or other lifecycle filings if triggered. “Approval received” is not proof that every separate launch and post-market obligation is complete.

For change categories covered by Enforcement Rule Article 24, the rule specifies a 30-day period after the change for the relevant amendment application or change notification; reportable changes follow the deadline at the end of the month after the quarter in which the change occurred. The Act cross-applies change rules to importers. Identify the correct category and recipient rather than treating every revision as a simple report.

IVD filing-service deliverables and permission-holder handover

A credible registration-service deliverable is a signed route memo; an applicant/responsibility map; an indexed dossier with missing-evidence tracker; final Korean filing pack; submission proof; a regulator-query register; and a controlled handover file after decision. Distinguish document preparation from the legal act of filing, and state who holds the permit.

For a cross-device overview, see the general MFDS device filing service. For upstream route assessment rather than execution, see the registration consultant scope.

Questions about filing an IVD with MFDS

Can a foreign assay manufacturer file directly without a Korean importer?

For import business, Article 11 places the permit and product filing duties on an importer operating under the Korean scheme. Identify and document the actual Korean applicant before assembling the submission; appointing a consultant alone does not transfer that duty.

Does a Class II IVD always go to NIDS?

No. Only the Class II categories and products meeting the certification route qualify; other Class II IVDs, including certain non-equivalent ones, require MFDS approval. Check Article 5 and the product listing first.

Can an existing FDA clearance or CE certificate replace Korean technical data?

Do not assume so. Foreign documentation can inform the dossier, but the Korean route determines what is required. Article 26 provides a narrow identical-product evidence exception that must be demonstrated on its own terms.

What changes for an IVD intended for home self-testing?

Check usability material under MFDS Notice 2026-58 alongside the usual product, labelling and performance claims. The amendment concerns self-testing IVD reagents and instruments; it should not be mechanically applied to every laboratory IVD.

Check both the usability-evidence provisions and the possible exemptions under Article 26 and Schedules 7–8 of the MFDS Notice; Article 27 addresses acceptable supporting data. A self-test dossier cannot be treated as automatically exempt or automatically subject to the same evidence in every case.

What happens if the applicant changes a model or clinical claim after submission?

Assess whether the change alters approved scope or technical evidence; log it, compare it with the submitted file and determine whether the authority requires supplementation, an amended permission or a separate filing. Do not assume a model-name change is always administrative.
