South Korea Mfds Medical Device Registration Consultant

Scope and evidence must be confirmed before any paid tests or filings.

A South Korea MFDS medical device registration consultant should decide the regulatory route before commissioning tests or assembling a filing. A CE mark, US clearance or existing global technical file can inform that assessment but does not itself establish a Korean authorisation.

This advisory page addresses the route decision, evidence reuse, risk and next action. It is not a filing checklist or an offer of regulator endorsement. Confirm product-specific requirements against the current Korean rules before spending on testing.

Start with the product boundary, not a guessed class

Record the exact proposed Korean intended use, patient/user, setting, mechanism, contact or implant characteristics, software functions and every model/accessory. Marketing claims can change whether the article is a medical device and its applicable classification.

  • Exact Korean indication, target population and user
  • Operating principle, materials, body contact and duration
  • Software functions, algorithm updates and clinical claims
  • Model/variant differences, accessories and proposed labels

If it is an in-vitro diagnostic (IVD), stop applying the general-device assumptions: Korea has a distinct IVD framework. For a borderline drug, combination product or digital-health function, seek a product-specific classification position rather than extrapolating from an overseas class.

Route-choice matrix: what changes the filing path

Provisional outcomeWorking routeCritical check before commitment
General device, Class ITypically product notificationVerify the precise MFDS item code and any special rule; do not assume that every product called “low risk” abroad is Class I.
General device, Class IITypically certification; some require MFDS approvalCheck equivalence and exclusions, especially novelty, clinical evidence or special technology.
General device, Class III or IVMFDS approvalScope technical review and any clinical evidence according to device features; a foreign approval is not an automatic shortcut.
IVD, borderline or combined technologySeparate regime/classification analysis firstIdentify applicable IVD, combination or software rules before assigning a general-device route.

This is a decision aid, not a legal classification determination. The MFDS describes risk classes I–IV and notification, certification and approval; the precise route depends on product code and review conditions.

Test an equivalence argument before reusing evidence

Do not equate similarity of appearance with regulatory substantial equivalence. Compare a specific Korean legally marketed reference, if one is identifiable, against the proposed device and document every difference:

  1. Intended use, indications and patient population
  2. Mechanism of action and relevant operating principle
  3. Patient-contact materials, design and safety-critical differences
  4. Performance claims, test specifications and instructions for use

MFDS guidance distinguishes general technical-document review from safety-and-efficacy review where differences may affect safety or efficacy. Existing CE, FDA, ISO or laboratory evidence may be useful input, but its Korean acceptability, coverage, format and age must be checked item by item. Never assume a blanket exemption from clinical evidence.

Gap ledger: convert unknowns into decisions

Use a gap ledger with an owner and decision gate. The following rows are a consultant’s review tool, not an exhaustive list of legally required submissions:

Importer and control of dossierProspective Korean importer, business-licence status, document rights, change noticesConfirm who is eligible to file and who can maintain access if the commercial partner changes.

For a new intended use or clinically significant mechanism change, treat the clinical-evidence question as an open decision—not as a standard test purchase. The extent of review and required documents is device-dependent.

Sequence the decisions and assign the Korean party

A defensible advisory engagement produces a written route memo and evidence map, not a promise of approval. Work in this order:

  1. Freeze a Korea-specific claims and variant baseline; identify any borderline or IVD issue.
  2. Map candidate Korean item code and class, and the notification/certification/approval branches with reasons and uncertainties.
  3. Audit each existing report against Korean requirements; label gaps by regulatory risk, owner and dependency.
  4. Confirm importer/business licensing, KGMP applicability and document-control responsibilities; then authorise testing or filing.

For execution after the route is set, see the medical device registration execution service; the IVD-specific registration service.

Plan for variants and post-authorisation change

Prioritise change control early. An added indication, modified materials or mechanism, new model, software update, manufacturing-site change or importer change can affect classification, evidence, KGMP scope or the required regulatory action. A decision made for one model cannot automatically be copied to its whole product family.

  • Keep a variant-to-claim-to-evidence map and log new claims before commercial use.
  • Specify who evaluates changes, communicates with the Korean importer and retains source reports.
  • Recheck the current MFDS Korean provisions at the time of filing; English summaries and older approval charts may lag later amendments.

If device status is genuinely uncertain, assess applicable non-medical regimes separately; for unrelated electrical products see the KC certification advisory page.

Frequently asked questions

Does a CE mark or FDA clearance remove the Korean filing requirement?

No automatic recognition follows from those approvals. They can provide technical evidence, but the Korean item classification, route, importer and supporting documents still need their own assessment.

Can every Class II device use certification instead of MFDS approval?

No. MFDS distinguishes certification for eligible Class II devices from approval for certain Class II cases, including novel products and other exceptions. Determine the exact item and review conditions first.

Can we reuse our existing clinical and laboratory reports?

Possibly. Compare their scope, standards, device version and claims with Korea’s expected evidence. If differences may affect safety or efficacy, additional review or clinical support may be necessary.

Can an overseas manufacturer file without a Korean importer?

MFDS describes an import-business licence framework for importing medical devices. Confirm the legally eligible Korean applicant and allocation of document rights before assuming the overseas manufacturer can file directly.

When should we commit to KGMP or local testing?

After deciding the device route and reviewing the actual evidence gaps. Check the current KGMP rules and whether the specific device and manufacturing sites require further assessments; do not buy tests only from a generic class chart.
