Product Compliance And Market Access Services In Vietnam
Entering Vietnam is not a single-certificate exercise. The first deliverable is a product-by-product route decision: identify the intended use, the exact configuration, the Vietnamese HS classification and the applicable sector list before ordering tests or shipping stock.
This national market-access map explains who may regulate a product, which decisions must be made in parallel and when to move to a specialist file. It is not a substitute for a product-specific legal or technical assessment.
Vietnam entry: confirm the HS code, function and governing sector before testing
Vietnam has a general product-quality and technical-regulation framework, but sector rules determine whether conformity assessment, a declaration, a product notification, specialist permits, an energy label or other controls apply. A Vietnamese national technical regulation (QCVN) is not the same as a voluntary national standard (TCVN); do not turn a test standard into a universal licensing requirement. A TCVN can nevertheless have binding effect to the extent that applicable legislation or a QCVN expressly incorporates it; check the legal basis and the precise scope.
Start with both the HS code and functional description. A connected appliance may combine a radio module, electrical-safety requirements and an energy-efficiency obligation. An apparent borderline product with a treatment claim may leave the ordinary consumer-goods route entirely.
Vietnam product-to-regime routing matrix
| Product / factual trigger | First regulator or regime to check | Decision that remains open |
|---|---|---|
| Radio, Wi-Fi, Bluetooth or telecom function | Ministry of Science and Technology (MOST), ICT/radio provisions in Circular 36/2026 and relevant QCVN | Check HS code, equipment description, frequency/power, embedded modules and actual risk tier; certification and declaration must not be presumed identical. |
| Household electrical item, lighting, toy or cable | MOST product quality and its high/medium-risk schedules under Circular 36/2026 | Match exact product characteristics and applicable QCVN; determine conformity-assessment method and any required mark. |
| Air-conditioner, refrigerator, fan or other energy-using equipment | Ministry of Industry and Trade (MOIT), energy-efficiency and product controls | Assess energy-label and minimum-performance coverage independently of safety/EMC. |
| Food, supplement or food-contact article | Food-safety sector rules and relevant authorities (often Health, MOIT or Agriculture/Environment according to product) | Check category, declaration/registration and import inspection under the rules actually in force. |
| Cosmetic or product making medicinal claims | Ministry of Health (MoH): cosmetic notification versus medicine classification | Claims, ingredients and intended use decide the route; cosmetic notification is not medicinal authorization. |
| Medical device or in-vitro diagnostic | MoH medical-device regime: Decree 98/2021 as amended; Circular 24/2026/TT-BYT | Confirm device status, risk class, local responsible organization and the relevant notification/registration path. |
| Chemical, mixture or treated article | MOIT chemical legislation and relevant product-sector controls | Screen composition, hazardous-substance rules and the legal distinction between chemical and article. |
Apply the 2026 rules, not an expired list
The product-quality and standards statutes were amended by Laws 78/2025/QH15 and 70/2025/QH15, effective 1 January 2026; Decree 37/2026/ND-CP followed on 23 January 2026. MOST Circular 36/2026/TT-BKHCN, effective 1 July 2026, sets medium-/high-risk lists and replaced the older telecom/ICT Circular 29/2025. For new filings, do not use a list merely because a 2024 or 2025 service page still quotes it.
Ministry-specific product lists need a separate check: MOIT Circular 33/2026/TT-BCT took effect on 1 July 2026; Ministry of Agriculture and Environment Circular 27/2026/TT-BNNMT must be read as amended by Circular 44/2026/TT-BNNMT, effective 9 October 2026. Neither list should be confused with MOST Circular 36/2026.
For food and food-contact goods, MoH Circular 27/2026/TT-BYT also establishes a medium-risk list within that ministry’s remit. Its existence does not by itself reinstate the suspended food Decree 46/2026: check how the list and the currently operative food-safety rules apply to the particular product.
For chemicals and hazardous chemicals in products, screen Law 69/2025/QH15 (effective 1 January 2026) and its implementing Decree 26/2026/ND-CP (effective 17 January 2026). For cosmetics, read Circular 06/2011/TT-BYT together with its 2025 amendment, Circular 34/2025/TT-BYT (effective 18 August 2025).
Medical devices have a separate 2026 checkpoint: MoH Circular 24/2026/TT-BYT, effective 1 July 2026, addresses risk determination and management measures for medical devices and amends Circular 05/2022/TT-BYT. Read it with Decree 98/2021 as amended; neither the MOST risk list nor a supplier’s foreign classification settles the Vietnamese medical-device route.
Food is a separate 2026 trap: Resolution 15/2026/NQ-CP suspended application of Decree 46/2026 and Resolution 66.13/2026 pending the future amended Food Safety Law and its implementing decree; the government states that Decree 15/2018/ND-CP continues to apply during that suspension. Verify whether the suspension still governs at the intended filing date. No universal deadline, fee or approval duration can be inferred from this market overview.
Five release gates: from specification to first sale
| Release gate | What must be evidenced | Do not advance if… |
|---|---|---|
| 1. Fix the SKU and HS mapping | Final datasheet, function/claims, photos, variant list, component and radio specifications, provisional HS rationale | The proposed HS code conflicts with the described functions or a module is omitted. |
| 2. Determine all regimes | Dated applicability matrix: sector authority, effective QCVN, risk category and explicit exemption basis if claimed | Only one of several applicable technical/sector regimes has been screened. |
| 3. Validate the applicant and tests | Named Vietnamese importer/responsible entity where required; sample plan; acceptance of lab/test reports under that exact scheme | A foreign certificate is assumed sufficient without domestic acceptance review. |
| 4. Clear pre-market gates | Required assessment, declaration/notification/registration, import inspection, labels and evidence of the actual approval scope | Commercial release is scheduled before a required product-specific step. |
| 5. Control changes and later lots | Approved model scope, certificates, label artwork, importer records, batch traceability, change log and surveillance calendar | Firmware, radio module, factory, claim or supplier changes have not been screened for a new obligation. |
Vietnam market-entry intake file and accountable parties
A useful initial screening file contains the following eight items; they are intake information, not a claim that every law requires every document.
- Product name, photos, complete SKU/version list and declared end use.
- Technical specifications: electrical ratings, radio frequencies/power, connectivity, software and component variations.
- Draft HS classification with supporting description; country of origin and manufacturer identification.
- Ingredient/material composition and safety/medical/food/cosmetic claims, if relevant.
- Existing CE, IEC, ISO or other testing certificates plus test methods, report dates and model coverage.
- Proposed Vietnam importer, distributor or other legally responsible entity; authorization if required by the chosen regime.
- Vietnamese-language label draft, packaging images and user instructions; check Decree 43/2017 as amended by 111/2021.
- First-shipment date, lot sizes, manufacturing site, later variants and planned technical changes.
Allocate accountability by deliverable: manufacturer supplies truthful specifications and maintains technical evidence; Vietnamese importer/market actor confirms its statutory filings and import role where applicable; testing/certification body acts only within its recognized scope; adviser documents classification assumptions and unresolved questions. A service provider is not automatically the legal applicant or local representative.
Where the hub stops and specialist work begins
For telecom and radio approval execution—specific QCVNs, test plans, filing steps and applicant documents—continue to the Vietnam telecom certification specialist page. For multi-country program management rather than Vietnam-specific law, use the global product market-access overview. This country hub owns the routing decision; it does not declare any given SKU approved or replace specialist classification.
Official sources for verifying the route
Official texts to recheck at the time of filing. References are sources for the route—not a finding that every measure applies to every product.
Vietnam market-access FAQs
- Does a Bluetooth appliance need one Vietnam approval or several?
- Possibly several separate checks. Screen the complete SKU against the current MOST risk list and applicable QCVNs, then separately assess electrical safety, EMC and energy labeling if relevant. The wireless module certificate alone is not a blanket approval for the finished product.
- Can CE marking or an IEC test report replace Vietnamese conformity steps?
- Not automatically. Existing reports can be valuable evidence, but acceptance depends on the exact Vietnamese regulation, assessment method and recognized body/laboratory rules. Obtain a written gap-and-acceptance decision before skipping tests.
- Should a food importer follow Decree 46/2026 immediately?
- Do not assume so. Resolution 15/2026 suspended its application and the government directed continued application of Decree 15/2018 during the suspension. Check the latest official status when filing; any later replacement changes the answer.
- Does an earlier approved shipment clear every later batch?
- Not necessarily. Distinguish type/model certification, lot-based assessment, declarations and import inspections. Verify certificate scope, permitted reuse and change triggers for each applicable measure; do not equate a previous declaration with unlimited future clearance.
- What if a personal-care device is marketed with medical claims?
- Freeze the claim wording and intended-use evidence first. Screen whether the product is cosmetic, medical device, medicine or ordinary electrical equipment before choosing the authority. Advertising language can change classification; do not assume the cosmetic route is sufficient.
