Medical Device Registration Services In Brazil
A Brazilian medical-device filing begins with a defined intended use, a named Brazilian applicant and a model-by-model evidence inventory. ANVISA (Agência Nacional de Vigilância Sanitária) uses notification for eligible lower-risk devices and registration for higher-risk devices. Neither a foreign certificate nor the act of sending a petition alone is proof that the device may be marketed.
Choose the petition route before collecting forms
Classify the actual finished device by its intended purpose and the relevant risk rule, not by a distributor’s description. For non-IVD medical devices RDC 751/2022 is the principal classification and filing framework. Confirm whether the product is a medical device at all and whether an accessory or software needs its own scope.
| Risk class / route | What is filed | Release checkpoint |
|---|---|---|
| I–II — notification (notificação) | Product notification, prescribed electronic forms and documents; maintain the complete technical file for inspection. There is no prior technical dossier review in the ordinary notification process. | Verify that ANVISA issued/published the notification number; a draft or fee receipt is not authorization. |
| III–IV — registration (registro) | Registration petition and a structured technical dossier subject to ANVISA’s substantive review, plus applicable manufacturing and product conformity evidence. | Verify the granting act in the Diário Oficial da União (DOU) and approved scope before marketing. |
In-vitro diagnostic devices (IVDs), including relevant instruments, follow RDC 830/2023 instead of treating RDC 751 as the complete IVD rulebook. The risk-class split is still notification (I–II) versus registration (III–IV), but the dossier and classification rules differ.
Identify the applicant and allocate document responsibility
A foreign manufacturer cannot directly obtain the Brazilian product authorization in its own name without an eligible Brazil-established holder. The Brazilian applicant needs the appropriate company registration and operating authorizations for the activity (including AFE where applicable). Fix the holder, manufacturer and actual importer identities before writing the petition; importing authorizations must be reviewed separately.
| Party | Practical filing deliverable |
|---|---|
| Legal manufacturer | Signed intended-use and model list; design, verification/validation, clinical/performance and production evidence; manufacturing-site details; authorization of Brazilian applicant for imported devices. |
| Brazilian holder / applicant | CNPJ and ANVISA system access, activity authorizations where required, correct petition subject code, forms, fee payment, dossier submission, responses to ANVISA and controlled post-filing records. |
| Regulatory adviser / filing coordinator | Route memo, gap matrix, version-controlled submission index, translation/label consistency review, deficiency-response tracker and handover package; the adviser does not replace the legally responsible holder. |
Build the dossier around the petition checklist
Use the current ANVISA checklist for the selected assunto de petição and Annex II of RDC 751/2022 to organise the technical dossier. This is a working evidence map, not a claim that every item is uploaded in every notification. For I–II, technical evidence must remain available for inspection; for III–IV, assemble the structured submission chapters.
- Identity: legal manufacturer, manufacturing sites, Brazilian applicant, product name, intended users/use, risk rule and class.
- Scope: complete catalogue of variants, model codes, accessories, configurations and proposed single-product or family grouping.
- Technical file: device description, design, production, risk management, performance, testing, sterilisation/shelf-life where relevant, and clinical evaluation appropriate to claims.
- Commercial presentation: Portuguese-market labelling and instructions for use, consistent with intended use, warnings, models and dossier.
- Administrative evidence: prescribed forms and signatures; for imported devices, manufacturer’s authorisation with required authentication/language treatment as applicable.
- Conditional certificates: assess ANVISA GMP certificate/CBPF for III–IV and applicable SBAC/INMETRO conformity evidence for regulated equipment; record why a certificate is or is not required.
Submission workflow: six decision gates
- Lock the intended purpose, model list and product type; distinguish conventional devices, IVDs and any special route.
- Document the risk rule, class, filing regime and grouping basis; decide single registration versus family before submitting.
- Verify the Brazilian holder’s CNPJ, ANVISA access, activity authorisations and manufacturer letter; resolve missing prerequisites.
- Obtain the live subject code/checklist; reconcile evidence, labels and mandatory attachments. Check conditional CBPF and INMETRO requirements.
- Submit through ANVISA’s applicable electronic petitioning flow (including Solicita where directed); pay the generated TFVS/GRU and retain protocol confirmation.
- Monitor document status and authority requests; answer within the applicable communicated deadline, verify the DOU decision/notification publication and archive the approved scope.
Avoid preventable rejection and delay
| Finding | Safe corrective action |
|---|---|
| Incorrect risk rule, IVD category or petition subject | Reassess intended use and applicable RDC; select the correct petition checklist before payment. |
| Mismatched manufacturer, holder, model codes or family grouping | Reconcile authorisation letter, forms, labels and dossier; do not assume a single-product approval can later become a family approval. |
| Missing mandatory form, signature or attachment | Run item-by-item completeness QA; ANVISA warns that incomplete applications may be summarily rejected, not necessarily returned for supplementation. |
| Unresolved CBPF, product certification or inconsistent technical evidence | Map prerequisites early; for applicable III–IV equipment a CBPF petition protocol may support filing, but final grant depends on the relevant certificate. |
After filing: manage the actual authorization, not just the number
Notification does not require periodic revalidation, but remains subject to ANVISA oversight. Registration for classes III–IV is normally valid for 10 years from DOU publication. For registration renewal, ANVISA describes a filing window between 12 and 6 months before expiry. These are regulatory milestones, not promises of a decision date.
- Before launch, match the published authorization to manufacturer, models, intended use, labels and any certificate-dependent conditions.
- Control changes to design, software, sterilisation, manufacturing site, legal manufacturer, holder and labelling: classify the change under the applicable variation rules and submit where required before implementation.
- Maintain technical records, complaint/vigilance and corrective-action processes, updated instructions and a renewal calendar; verify separate import permits and distribution duties.
Where this filing service ends
This page owns petition preparation, documentary alignment, submission and authority-response execution. Product-wide compliance strategy, standalone INMETRO conformity assessment and IVD-specific filing have different primary work products:
What a registration-execution mandate should deliver
Request a written scope covering the named Brazilian holder, device/model inventory, risk-rule rationale, petition code, required technical-file chapters, missing evidence, conditional certificates, Portuguese labelling review, filing receipt, authority-question ownership and post-approval handover. Fees and duration depend on the actual subject code, company profile, product type and outstanding testing or certificates; no guaranteed approval or fixed timetable is implied.

Filing-specific questions
- Can my foreign factory file directly with ANVISA?
Not as the holder of a Brazilian marketing authorization. An eligible Brazil-established applicant must be responsible; settle its authority and the manufacturer’s appointment before dossier submission.
- Does a class II notification mean no technical file or waiting for a number?
No. The holder retains the technical documentation for inspection and should verify the completed notification and its published number rather than relying on a draft petition.
- Can I add any model later to a single-product class III registration?
Not by simply relabelling the file as a family. ANVISA says single-product and family registrations cannot be converted into each other after approval; choose the grouping at the start and evaluate changes separately.
- Can a class III equipment registration be granted with only a CBPF application receipt?
ANVISA indicates the CBPF application protocol may allow the product petition to be submitted, but granting the marketing authorization depends on the GMP certificate being issued.
- Is an EU CE mark or an FDA clearance a substitute for ANVISA filing?
No automatic substitution follows. Foreign decisions may be relevant to evidence or an applicable reliance mechanism, but the device still needs the appropriate Brazilian route and authority decision.
