Reach Consulting Services In Germany
REACH consulting in Germany should begin with a decision, not a quotation for laboratory testing or a registration dossier. Regulation (EC) No 1907/2006 applies across the EU; the correct route depends on the legal actor, the substance, its form, annual quantities and intended uses. REACH registration, restriction and authorisation are different questions; CLP classification and labelling must be screened separately.
This advisory route map identifies what must be clarified before execution. It is not an automatic finding that a specific substance or product may be sold.
Start with the substance, role and supply chain
Check each relevant row: the same business can be an importer for one flow and a downstream user for another. Annual tonnage is assessed per substance and relevant legal entity, combining applicable flows—not by the number of finished mixtures.
Decision matrix: which REACH route applies?
| Business situation | Decision-changing facts | Next strategic step |
|---|---|---|
| EU/EEA manufacture or import of a substance | Identity, legal entity, tonnes per year and exemptions; at or above 1 tonne/year registration generally needs assessment. | Determine registrant and exemption status before sourcing studies or filing. |
| Import of a mixture into Germany | Constituent substances, their percentages and the importer’s combined annual volumes across mixtures and other imports. | Calculate per-substance tonnage; a mixture itself is not registered as one substance. |
| Purchase from outside the EEA | Who imports, and whether an eligible non-EEA manufacturer/formulator has appointed an EEA only representative covering the importer, substance and volume. | Obtain evidence of coverage; do not assume the foreign supplier’s registration automatically covers you. |
| Use of EU/EEA-sourced chemicals | Supplier registration/communication, safety data sheet (SDS), exposure scenario and whether your actual use is covered. | Assess downstream-user duties and exposure controls rather than automatically initiating a second registration. |
| Manufacture or import of an article | Is there intended substance release? Are Candidate List substances present in an individual article above 0.1% w/w? Quantity, use and exemptions also matter. | Split intended-release registration, article communication and potential notification into separate assessments. |
Evidence to collect before commissioning work
Prepare a short evidence pack with named owners and document dates. A supplier declaration alone is not proof for every REACH obligation.
- Legal-person map: EU/EEA manufacturer, importer, distributor, downstream user, and any only representative; identify the contractual importer for each flow.
- Substance inventory: names and identifiers, composition and concentration ranges, impurities where relevant, annual mass balance per substance and legal entity.
- Use file: industrial/professional/consumer uses, exposure conditions, article release behaviour, markets and SDS/exposure scenarios in use.
- Existing proof: registration and supply-chain confirmation, supplier declarations, study access rights, Candidate/Authorisation/Restriction List screening with dates and unresolved questions.
Gap analysis: reuse evidence or close a real gap?
Prioritise unanswered questions using this targeted gap matrix; do not order new tests simply because a file is incomplete.
| Observed gap | Potentially reusable material | Decision before spending |
|---|---|---|
| Substance identity uncertain | Supplier specifications, spectra, composition/analytical data. | Resolve sameness and boundaries of substance identity; a CAS number alone may be insufficient. |
| Registration route or coverage unclear | Invoices, import flows, only-representative appointment and coverage confirmation. | Assign the correct duty holder and check tonnage and applicable exemptions. |
| Hazard endpoint missing for registration | Existing robust studies, joint-submission data, literature and accepted adaptations. | Assess legitimate access and data-sharing; animal tests are a last resort, not a default. |
| Use or risk control not documented | SDS, exposure scenarios, customer process data and risk measures. | Compare real use with covered use; plan supplier clarification or a defensible downstream-user route. |
Sequence decisions before tests or filing
- Freeze product/substance identity and the legal-entity supply-chain map.
- Calculate relevant per-substance tonnage; test exemptions and registration/authorisation/restriction applicability independently.
- Request missing proof from suppliers and assess lawful reuse of data or an existing joint submission.
- Only then define a bounded execution brief: dossier, exposure assessment, additional studies, supplier negotiation or operational controls, with responsible party and decision owner.
Change triggers that reopen the assessment
Reassess the route when facts change; an old declaration is not permanent clearance.
- A new importer, manufacturer, only representative, supply route or a higher per-substance annual volume.
- A changed formulation, impurity profile, intended use, exposure pattern, release function or article component.
- An update to the Candidate List, Annex XIV authorisation or Annex XVII restriction conditions, or new hazard/SDS information.
What REACH advice covers—and what it does not
The deliverable of an advisory engagement should be a reasoned route decision, evidence-gap register, ownership map and sequenced next-action plan—not a claim that advice itself constitutes registration or regulatory approval.
If a finished product separately requires CE assessment, address that under CE marking consulting in Germany; CE marking is not a substitute for evaluating REACH obligations. Germany’s federal REACH–CLP–Biocide Helpdesk provides official guidance; it does not act as a private consultant or pre-approve products.
Frequently asked questions
Does a mixture need one REACH registration?
No. Where registration is required, it concerns the relevant constituent substances, based on the importer’s/manufacturer’s obligations and aggregate substance volumes. CLP duties for the mixture are a separate check.
Our imports are below one tonne. Can we ignore REACH?
No. The 1 tonne/year threshold concerns general substance-registration duties; restrictions, safety-data-sheet/communication rules and relevant article duties may apply independently. Check the legal actor and exemptions.
Does our non-EEA supplier’s registration protect the German importer?
Not automatically. Establish whether an eligible EEA only representative has been appointed and whether the documented coverage actually includes your importer, substance, tonnage and supply flow.
Does 0.1% SVHC automatically mean ECHA notification?
No. Communication for Candidate List substances above 0.1% w/w in each article must be assessed separately from notification, which also generally involves over one tonne/year of that substance and statutory exceptions. Check the current Candidate List and the individual article.
Should we commission new testing before joining a registration?
Usually not as the first step. Verify identity, data needs, access to existing joint-submission data and acceptable adaptations. Vertebrate testing under REACH is a last resort.
