Product Compliance And Certification For Medical Device In Switzerland
A Swiss medical-device launch is not a single “Swiss certificate” application. First establish the manufacturer’s intended purpose, then map the device or IVD route, any parallel product rules, the conformity evidence and the Swiss economic operators. Swissmedic generally relies on the CE conformity-assessment system rather than issuing a routine pre-market device approval; CE status does not remove Switzerland-specific representation, registration, labelling or vigilance duties.
First decision: what exactly is being marketed?
Freeze the actual claim set before assigning a risk class. The same hardware can follow different routes when sold for a diagnostic purpose, for laboratory research or as a medicine-delivery component. Document the primary mode of action, intended user, patient population, sample type and setting.
| Feature or claimed use | Swiss route to examine | Decision evidence still needed |
|---|---|---|
| Diagnoses, treats, monitors or supports a patient without a primarily pharmacological action | MedDO; apply EU-MDR Annex VIII rules: Classes I, IIa, IIb or III | Indication, duration of contact, invasiveness, active function, implant status and intended user. |
| Examines human specimens to produce diagnostic information | IvDO; apply EU-IVDR Annex VIII rules: Classes A, B, C or D | Specimen, analyte, clinical claim, self-test/near-patient use and significance of a wrong result. |
| Software interprets patient data or guides clinical decisions | Determine whether standalone software is a medical device or an IVD; classify its clinical function | Input/output, significance of each decision, intended medical purpose and integration with hardware. |
| Medicine and device are supplied together | Check which component has the principal action: drug-led combinations may follow medicinal-product law | Mechanism of action, inseparability, presentation and whether the device is independently supplied. |
| No medical claim, but within a specifically regulated aesthetic-product group | Check MedDO scope for products without an intended medical purpose | Exact product group and applicable common specifications; absence of a medical claim alone is not decisive. |
| Patient-specific manufacture or assembled system/procedure pack | Check special MedDO rules and remaining form-notification obligations | Prescription and design particulars, assembly scope, constituent CE status and labelled intended purpose. |
| Wireless/connected device | Check medical-device rules plus, where applicable, Swiss radio-equipment requirements | Radio interfaces/frequencies, connectivity, power supply and intended configuration. |
Custom-made is a legal category, not a synonym for personalised. A MedDO custom-made device requires patient-specific design characteristics in a written prescription from an authorised professional for one identified patient. A mass-produced device adjusted at the point of care, or an industrially manufactured patient-matched device, is not automatically custom-made; establish the distinction before using a special notification or documentation route.
Product-by-product regulatory stack
The medical-device classification is the core route, not the entire legal stack. Apply the next layer only when the product facts activate it:
| Layer | Trigger | Launch consequence |
|---|---|---|
| MedDO / IvDO | Medical device / examination of specimens in vitro | Choose the correct conformity pathway, evidence, CE marking and post-market obligations. |
| Medicinal-product interface | Primary action is medicinal or a combination includes a medicine | Do a documented borderline/combination analysis; do not present a drug-led product as a stand-alone device. |
| Radio / electrical interfaces | Contains radio functions or other functions covered by parallel rules | Confirm product-specific OFCOM/other applicable requirements; CE medical evidence alone is not the full radio dossier. |
| Swiss market actors | Manufacturer outside Switzerland; import from abroad | Document CH-REP where required and identify the actual Swiss importer/distributor and their separate responsibilities. |
| Swiss registration | Commercial supply of covered devices/systems in 2026 onward | Check actor CHRN, device UDI-DI registration and importer linkage; EUDAMED records do not automatically populate swissdamed. |
| Language / information / safety follow-up | Each device offered, delivered or monitored in Switzerland | Verify German/French/Italian product information or legally applicable exception, label identities, traceability, complaints and Swiss vigilance. |
Risk class and evidence: what a CE mark proves—and does not
For ordinary non-IVD devices, risk classification runs I → IIa → IIb → III; for IVDs, A → B → C → D. The manufacturer must justify the actual rule, not guess from a product name. A regular Class I device (without sterile/measuring/reusable surgical features) and a regular Class A IVD can generally use the applicable manufacturer-declaration route; other classifications or special features can trigger designated/notified-body involvement. Check the current certificate scope, expiry and any legacy-device transition before relying on old documentation.
A launch file should connect intended purpose → risk rule → general safety and performance requirements → risk controls and testing → clinical evaluation (or IVD performance evaluation) → declaration of conformity and certificate where required. Relevant standards are evidence tools or may confer a presumption for covered requirements; an ISO certificate by itself is not a legal Swiss market authorisation. Swissmedic does not issue routine product-by-product device approvals.
Check what the CE mark actually covers: radio or electrical conformity alone is not an MDR/IVDR medical-device assessment. A US FDA clearance or approval alone is not currently a substitute for the Swiss-recognised conformity route; the proposed Swiss FDA pathway remains a legislative project. Check any older Directive certificate only against the applicable legacy transition conditions.
Swiss responsible parties and the 2026 registration gate
Separate legal manufacturer, Swiss authorised representative (CH-REP), importer and distributor even if one business performs more than one role. “We have an EU representative” is not an answer to the Swiss representation question.
Jurisdiction exception: under the current Switzerland–Liechtenstein arrangements, a manufacturer established in Liechtenstein does not have to appoint a separate Swiss CH-REP, although applicable Swissmedic actor registration and device duties remain. Verify the establishment and current treaty rules; do not apply this exception to an ordinary EU-based manufacturer.
| Actor / situation | Specific Swiss gate to verify |
|---|---|
| Manufacturer established in Switzerland | Own conformity and document duties; Swissmedic actor registration/CHRN and relevant swissdamed device entries. |
| Manufacturer established abroad | A Swiss authorised representative under written mandate is normally needed; confirm mandate, label identity and product-registration ownership. |
| Swiss importer | Check conformity, CH-REP, UDI where applicable and Swiss importer contact details; register as actor and link to existing swissdamed device UDI-DIs, not register the devices itself. |
| Swiss distributor / health institution | Verify lawful supply, traceability and post-market cooperation; institution-specific manufacture or use may follow a separate special regime. |
As of 1 July 2026, swissdamed device registration applies to covered devices, IVDs, systems and procedure packs placed on the Swiss market. Most relevant entries have a transition to 31 December 2026, but devices tied to reportable serious incidents, field safety corrective actions or trends have no such transition. An importer’s technical UDI-DI linking function started on 1 October 2026; Swissmedic gives importers until 1 April 2027 for the linkage transition. Actor registration is a separate pre-first-placement duty. An EU EUDAMED entry is not a Swiss entry.
Optical-product timing is category-specific. For spectacle frames, spectacle lenses and ready-to-wear reading spectacles, Swissmedic says the Master UDI-DI obligation and swissdamed device registration start on 1 November 2028; its database FAQ specifies completion of device registration by 31 December 2028. The importer-linkage rule also has a separate optical timetable. Do not extend this exception to contact lenses.
Standard and made-to-order contact lenses requiring a Master UDI-DI have a different start date: 9 November 2026, with the corresponding swissdamed device registration to be completed by 31 December 2026. Establish the precise product category before deciding which date applies.
Label, language and launch-file release check
Use this document gate for the exact model, packaging variant and channel. A missing item is a hold point, not automatically evidence that Swissmedic offers a product approval process.
A narrower-language or English-only variant is not justified merely by calling the device “professional”. Under MedDO Art. 16(3) or IvDO Art. 15(3), verify the eligible supply/use category, the user’s professional and language competence and agreement, patient/user/third-party protection, and no loss of safe performance. Supply additional information in an official Swiss language if requested. For consumer or self-test use, do not presume the exception applies.
- Signed intended-purpose and borderline decision including medicine, IVD, software, aesthetic and radio triggers as applicable.
- Documented classification rule and justified conformity-assessment route; valid CE declaration and any required body certificate.
- Risk/technical file with applicable safety and performance evidence, clinical or performance evaluation and post-market plan.
- Written CH-REP mandate where needed, correct manufacturer/CH-REP/importer identities and actor CHRN checks.
- UDI and correct swissdamed device registration/transition assessment; importer link responsibility and date recorded.
- Label and instructions: German, French and Italian are the general Swiss language rule; verify any statutory exception before limiting translations. Check CH-REP address and importer contact particulars.
- Release sign-off for traceability, complaint intake, incident reporting, field safety actions and reassessment of modifications.
Changes and exceptional routes that invalidate a shortcut
Reopen the decision, rather than reusing the old certificate or label uncritically, when any of the following changes:
- Claim: “wellness tracker” becomes a diagnostic alert or clinical decision tool → reassess qualification and class.
- Design: sterilisation, measuring function, implant duration, algorithm or intended users change → reassess class and evidence/certificate scope.
- Market chain: a new foreign manufacturer, CH-REP, importer or trade mark appears → recheck mandates, printed information and swissdamed roles.
- Lifecycle: legacy certification, incident/FSCA, repackaging, custom-making or hospital in-house use → examine specific transition/notification rules; do not assume a blanket exemption.

Medical-device questions for Switzerland
- Is a CE mark alone sufficient for the Swiss market?
- No. A valid, applicable CE route is generally the conformity basis recognised by Switzerland; still check the CH-REP, Swiss importer, product information, actor/device registration, traceability and Swiss vigilance obligations.
- Can my Swiss importer register my product instead of the CH-REP?
- Importers register their own actor data and link their CHRN to UDI-DIs already entered in swissdamed; they do not perform the device registration in place of the responsible manufacturer or authorised representative.
- Does a basic non-sterile Class I device need a notified-body certificate?
- Not usually if it is truly ordinary Class I without sterile, measuring or reusable-surgical features. Classify the intended use first; software or special functions can change that conclusion.
- I sold units before July 2026. Is the model excluded from swissdamed?
- Not if further sales units are placed on the Swiss market after 1 July 2026: the registration rules also cover applicable legacy devices. Assess the 31 December 2026 transition and immediate vigilance-related exceptions.
- Can I ship with English-only instructions?
- Do not assume so. The general rule is product information in German, French and Italian. Evaluate the specific statutory exceptions and professional-use conditions for that device and buyer before releasing an English-only variant.
