IVDR Compliance Services In The Eu
EU IVDR compliance services are not a certificate sold by an adviser. They coordinate an in vitro diagnostic (IVD) device’s intended purpose, risk classification, quality system, performance evidence, technical documentation, any notified-body assessment and operational registration. Regulation (EU) 2017/746 (IVDR) is the governing law; a service provider can prepare and coordinate work, but cannot replace the manufacturer or issue a notified-body certificate.
The useful output is an evidence-backed release decision: what is complete, what is still missing, who must sign it and what prevents lawful placement on the EU market. The sequence below covers new IVDR devices and explains where the conditional legacy-device transition must be checked separately.
Choose the lawful route before commissioning work
The manufacturer first locks the claimed intended purpose, users, specimen, analyte, clinical context, result interpretation and device variants. Those facts—not the laboratory’s name or a consultant’s preference—drive Annex VIII classification and the Article 48 conformity-assessment route.
| Device route | Conformity assessment | Operational gate |
|---|---|---|
| Class A, non-sterile | Manufacturer prepares the required documentation and EU declaration of conformity; no notified body for the ordinary route. | Complete applicable IVDR evidence, QMS, registration and marking before release. |
| Class A, supplied sterile | Notified body involvement is limited to sterile-condition aspects. | Define sterilisation evidence and the notified-body interface early. |
| Class B or C | Notified body involvement under Article 48; sampling and special assessments depend on class and characteristics. | Reserve capacity, freeze the submission version and answer findings. |
| Class D / special cases | Notified body route with additional requirements that may include EU reference laboratory verification; companion diagnostics may require a medicinal authority/EMA consultation. | Map specific reviews and dependencies; do not assume every test follows the same path. |
Classification is device-specific. Self-testing, near-patient testing, companion diagnostics and software require particular attention. The routes above are a planning map, not a classification decision for an unnamed product.
Intake: make the manufacturer’s source material auditable
Ask for a controlled intake pack with named owners and versions, rather than a folder of unreferenced files:
- Signed intended-purpose and claims statement, device models/variants, IFU and labelling drafts, target users and EU markets.
- Classification rationale against Annex VIII, device status (new or legacy), any IVDD declaration/certificate and significant-change history.
- Design and manufacturing description, critical suppliers, QMS procedures, risk file and known nonconformities.
- Existing analytical data, scientific-validity literature, clinical-performance data, stability and specimen-handling evidence, including failed or inconclusive results.
- Economic-operator map: legal manufacturer, importer/distributor and—where the manufacturer is outside the EU—mandated EU authorised representative.
Six controlled stages from intake to market readiness
Each gate produces a signed or version-controlled artefact. A coordinator should not book a conformity assessment against a moving technical file.
| Stage | Execution and handoff | Exit artefact / decision |
|---|---|---|
| 1. Intake and route | Resolve intended use, borderline status, classification, legacy eligibility and responsible legal entities. | Approved scope, route memo, stakeholder/RACI map and missing-input register. |
| 2. QMS and evidence plan | Gap-check Article 10 and Annexes I–III/XIII; assign owners, test methods, acceptance criteria, samples and study permissions. | Prioritised gap log, QMS action plan and traceable evidence/test matrix. |
| 3. Generate and review evidence | Coordinate verification, analytical studies, scientific-validity appraisal and clinical-performance evidence; record deviations and retest decisions. | Reviewed reports, performance evaluation and risk-control traceability. |
| 4. Assemble the file | Version-control Annex II–III technical documents, GSPR evidence, performance evaluation, labels, PMS/PMPF plans and declarations in draft. | Submission-ready index with unresolved issues explicitly blocked. |
| 5. External assessment if required | Manufacturer applies to an appropriately designated notified body; coordinate audits, sample documentation, special consultations and responses. | Applicable notified-body certificates/decisions and a closed findings log, or a documented pending gate. |
| 6. Registration and release | Validate AR/importer arrangements, UDI, operator/device registration, EU declaration, CE marking and distribution controls. | Authorised release record, current identifiers and post-market ownership matrix. |
Testing and evidence: prevent avoidable retesting
Testing must follow a documented claims-to-evidence chain, not a generic testing bundle:
- Map each intended-use claim and relevant Annex I general safety/performance requirement to an acceptance criterion, source record and owner.
- Distinguish scientific validity, analytical performance and clinical performance; one result does not automatically prove the other two.
- Agree sample provenance, matrix, lot representation, comparator, statistical approach and study protocol before contracting a laboratory.
- For an out-of-specification or inconclusive result, document investigation, risk impact, change to method/device, the need to retest and which version is affected. Never silently discard failures.
- Close the evidence loop in the performance evaluation report and risk file; plan post-market performance follow-up (PMPF), including a documented justification if a particular activity is not appropriate.
Who does what when work is outsourced
Delegation of drafting, testing or project management does not transfer statutory manufacturer responsibilities:
- Manufacturer: owns intended purpose, classification, QMS, technical documentation, declaration and market release; remains accountable for conformity.
- External adviser/project coordinator: prepares gap analysis, plans, document control and handoff tracking; does not certify compliance or act as a notified body.
- Testing laboratory / study partner: performs agreed work and provides traceable methods, raw-data availability and signed reports; scope and competence must be verified.
- Notified body (where applicable): performs the designated independent conformity assessment. EU authorised representative (when required) acts under its written mandate, not as a substitute manufacturer.
Legacy devices and EUDAMED: check the date before the plan
Regulation (EU) 2024/1860 changed the conditional Article 110 transition. Eligible legacy devices may have final market-placement dates of 31 December 2027 (class D and qualifying IVDD-certified devices), 31 December 2028 (class C), or 31 December 2029 (class B and sterile class A). These dates are not an automatic extension for all stock or new devices.
Among other conditions, qualifying devices must remain IVDD-compliant, have no significant design/intended-purpose change or unacceptable risk, and meet QMS, notified-body application and written-agreement deadlines. For class D and relevant IVDD-certified devices those dates were 26 May / 26 September 2025; for class C, 26 May / 26 September 2026; for B and sterile A, 26 May / 26 September 2027. Check each condition and supporting records before relying on a transition.
From 28 May 2026 the first four EUDAMED modules are mandatory: Actor registration, UDI/Device registration, Notified Bodies & Certificates, and Market Surveillance (the last primarily for authorities). Account for role-specific registration and the applicable implementation/legacy rules; do not mistake entry in EUDAMED for an IVDR certificate.
Final release and post-market change control
Use an explicit no-go unless all applicable gates are closed:
- Intended purpose, classification, claims, labels and performance evidence agree on the released version.
- Necessary notified-body assessment and certificates are valid and cover that device/scope, or the documented lawful self-declaration/transition route applies.
- Technical documentation, QMS controls, EU declaration and CE marking requirements are complete for the applicable route.
- Responsible operators, UDI/registration, language-specific information and supply-chain controls have been verified for the markets concerned.
- A PMS/vigilance/PMPF owner and escalation route exist; changes to intended purpose, design, supplier, assay, software or performance claims trigger documented impact assessment before release.
Related tasks without duplicating them
For the narrower mechanics of applications and filings, consult the IVDR registration workflow. For wider device CE conformity outside this execution workflow, see EU medical-device CE certification. For mandates and non-EU manufacturer representation, see EU IVDR authorised-representative services. This page stays focused on the controlled handoffs that connect those tasks.
Questions that change the execution plan
Can a consultant issue the IVDR certificate after arranging the tests?
No. Where a notified body is required, only a designated notified body performs that conformity assessment; the manufacturer keeps its own statutory responsibilities. Tests alone are not certification.
Does a new class A non-sterile IVD need a notified body?
Usually not under Article 48(10). The manufacturer still needs applicable IVDR documentation, QMS, evidence, EU declaration, marking and registration obligations. Confirm the classification and non-sterile status first.
What if our clinical-performance data do not support one marketing claim?
Put that claim and release decision on hold. Reconcile the intended purpose, risk file and performance evaluation; justify additional study/retest or narrow the claim under controlled change procedures.
Can a class C legacy test still use the 2028 transition in October 2026?
Only if every relevant Article 110 condition was met, including the class C application by 26 May 2026 and written agreement by 26 September 2026. Check dated evidence; the 2028 date alone is insufficient.
Does EUDAMED registration replace a CE certificate or all national actions?
No. EUDAMED contains identification and registration records; it does not replace the applicable conformity-assessment route. Check applicable national requirements and outstanding module-specific arrangements separately.
