Eu Mdr Medical Device Compliance Consultant
An EU MDR medical device compliance consultant should settle the regulatory route before commissioning tests, paying a notified body or preparing registration data. This is a decision service—not a substitute for the manufacturer’s legal responsibilities or a promise that a device can be CE marked.
First decide whether MDR applies
Start with a version-controlled intended-purpose statement, the exact label, instructions, website claims, users, patient population, operating principle and all software outputs. Determine whether the product meets the MDR Article 2 definition, is an in-vitro diagnostic under the separate IVDR, is a medicinal-product/combination borderline, or is a relevant Annex XVI product without an intended medical purpose. An attractive health-related name or an existing CE mark under another law does not settle qualification. Document uncertainty before assigning any class.
Select the route from the product facts
Use this planning matrix as a fork, not a certificate or a substitute for a documented Annex VIII rule-by-rule assessment. MDR classes are I, IIa, IIb and III; the specific product and its features determine the outcome.
| Candidate situation | Likely strategic route | Do not assume |
|---|---|---|
| Outside MDR / possible IVDR or borderline | Resolve the legal regime and main intended action first; assess other applicable legislation separately. | An MDR technical file or CE label cures wrong qualification. |
| Ordinary class I (not sterile, measuring or reusable surgical) | Manufacturer generally uses Article 52(7) conformity assessment without a notified body; MDR evidence and EU declaration still required. | Low class means no technical, clinical, QMS or post-market obligations. |
| Class I sterile, measuring, or reusable surgical (Is/Im/Ir) | Notified-body involvement applies to the limited relevant aspects under Article 52(7). | The whole class I device is automatically fully assessed by the body. |
| Class IIa, IIb or III | Select the applicable Article 52/Annex IX–XI conformity route and a body designated for the device scope in NANDO. | Any CE consultant or any notified body can issue the relevant certificate. |
| Custom-made or investigational device | Check their separate MDR provisions; ordinary serial-device CE-marking assumptions do not automatically apply. | A bespoke order or trial label alone qualifies for an exception. |
| Existing MDD/AIMDD legacy device | Check both certificate-based Article 120(3a) devices and qualifying former MDD self-declared devices under Article 120(3b); inspect the old certificate or pre-26 May 2021 declaration, significant changes, 2024 application/agreement evidence and applicable conditions. | An old certificate or a future 2027/2028 date extends every product automatically. |
Custom-made devices generally follow Article 52(8) and Annex XIII rather than ordinary CE marking; a class III custom-made implantable device additionally needs the assessment specified in Article 52(8). Investigational devices follow the clinical-investigation provisions, not the normal marketed-device route. Check the definitions before using either exception.
Five facts that can reverse classification
A classification opinion must cite the applicable Annex VIII rule(s), competing interpretations, factual assumptions and what evidence would change the conclusion. April 2026 MDCG 2021-24 rev.1 is useful guidance, but it is not binding legislation.
- Claims and intended medical purpose: diagnosis, monitoring, treatment, wellness-only or non-medical Annex XVI purpose may change the legal regime.
- Contact, invasiveness, duration and anatomical site: record the actual exposure and all variants, not a marketing category.
- Software’s clinical output and effect on decisions: evaluate qualification and Rule 11, not whether software is sold separately or uses AI.
- Sterility, measurement and reusable surgical function: class I may still require focused notified-body involvement.
- Substances, medicinal ancillary action, implants or special functions: assess any special classification and consultation triggers.
Rank gaps by the decision they block
A useful gap analysis is not a long unranked standards checklist. For each gap record the MDR requirement, existing evidence, adequacy, owner, remediation option, dependency and a go/no-go trigger. Escalate route-changing gaps ahead of routine formatting.
| Gate / priority | Evidence to inspect | Decision or stop condition |
|---|---|---|
| G1 — qualification/class (blocking) | Claims; product architecture; Annex VIII rule rationale; borderline analysis. | Do not book class-dependent testing or notified-body scope until defensible. |
| G2 — route and accountable actors (blocking) | Legal manufacturer; location; authorised-representative mandate if outside EU; PRRC arrangement; NANDO scope. | Assign responsibility and confirm an eligible route before submission. |
| G3 — safety/performance and verification (critical) | Annex I GSPR matrix; risk management; design validation; test reports with versions and endpoints. | Commission only tests that resolve a mapped requirement or uncertainty. |
| G4 — clinical evidence (critical) | Clinical evaluation plan/report; relevant data; equivalence rationale and access; PMCF plan if applicable. | Determine whether evidence is sufficient or a clinical investigation/other work is needed. |
| G5 — lifecycle/readiness (launch gate) | Annex II–III files; QMS; PMS/vigilance; UDI/Basic UDI-DI; applicable EUDAMED records. | Separate documents needed before conformity from implementation at market entry and after. |
Reuse existing evidence without assuming equivalence
Existing US FDA files, MDD reports, laboratory data, ISO 13485 certificates and prior clinical literature can reduce duplication only after a device-version, intended-purpose, population, endpoint, method, standard edition and MDR-requirement mapping. ISO 13485 certification is not MDR certification; an FDA decision is not an EU conformity assessment. Harmonised standards can support a presumption of conformity within the scope published in the EU Official Journal, but their use does not replace the law or fill unrelated gaps.
- Reuse: trace a report to the current device configuration, hazards, acceptance criteria and applicable GSPR, recording justified differences.
- Update: revise obsolete tests, missing risk controls, changed clinical claims or insufficient clinical data before calling the file ready.
- Reject automatic equivalence: especially for another manufacturer’s clinical evidence, check MDR Article 61/Annex XIV access and equivalence conditions; a similar product is not enough.
Sequence decisions before execution
The strategic deliverable should be a short decision register with owners, source citations, unresolved assumptions and evidence gates. A workable sequence is:
- Freeze the intended purpose and variants; capture contradictory claims before setting a class.
- Sign off qualification and classification rationale, including Rule 11 or borderline/Annex XVI analysis where relevant.
- Identify the legal manufacturer, EU authorised representative if required, PRRC arrangements, route and notified-body scope where applicable.
- Close the highest-risk GSPR, clinical and QMS gaps; decide whether new verification or clinical work is justified.
- For a notified-body route, register the relevant economic operator(s) in EUDAMED and secure the manufacturer’s SRN before applying (Article 31). Assign the Basic UDI-DI before the application where Article 29(3) requires it; this is distinct from completion of the device entry. Establish the applicable QMS, PMS plan/system, vigilance and change-control procedures before market entry—not only after CE marking.
- Complete the applicable conformity assessment, EU declaration and CE marking before placing the device on the market, and satisfy the applicable EUDAMED device-registration timetable. Continue PMS, vigilance and change control throughout the device life cycle. Since 28 May 2026, four EUDAMED modules are mandatory for their relevant users: actor registration, UDI/devices, notified bodies/certificates and market surveillance. Market surveillance is for authorities and the Commission, not a routine manufacturer filing.
Registration timing is not identical for every device. For a device first placed on the EU market on or after 28 May 2026, the applicable EUDAMED device entry normally precedes that first placing on the market. For devices already placed on the market before that date and still being placed afterwards, check the separate transitional registration window in MDR Article 123(3)(e), as amended, plus any relevant exception. Device registration is not a substitute for conformity assessment.
What the advisory mandate delivers—and does not
Ask the consultant for a signed or version-controlled route memo, classification-rule matrix, evidence-reuse register, ranked gap log and staged decision plan—not an unsupported “guaranteed CE” promise. The manufacturer retains its MDR duties. Detailed submission and device-record execution belong to the MDR registration service; appointment and mandate administration for a non-EU manufacturer belong to the EU authorised representative service. A consultant is not automatically a notified body or an authorised representative.

FAQ: difficult MDR route decisions
Does software that analyses symptoms automatically fall under Rule 11?
No. First determine the intended medical purpose and whether it qualifies as medical device software. Then apply Rule 11 and any other applicable Annex VIII rules to its actual output and decisions; the result cannot be inferred from an AI label.
Can a sterile class I device self-declare without any notified body?
Not for the sterile aspect. Article 52(7) requires notified-body involvement limited to the relevant sterility aspects; the manufacturer remains responsible for the remaining MDR obligations.
Can we use an FDA clearance or ISO 13485 certificate instead of MDR evidence?
No. Treat these as potential inputs to a documented gap and equivalence assessment. They do not replace the MDR classification, GSPR demonstration, clinical evaluation or applicable EU conformity procedure.
Does an existing MDD certificate permit a new design change through 2028?
Not automatically. Legacy extensions depend on Article 120 conditions, including the restrictions on significant design or intended-purpose changes and historical application/agreement requirements. Review the specific certificate and change before relying on a transition.
Should we register in EUDAMED before resolving classification?
Actor registration may be started once the relevant economic-operator role and EU representative, if required, are settled; it does not always have to await final device classification. First establish the device’s legal regime and identity before entering UDI/device data. For a new device placed on the market from 28 May 2026, check the pre-placement registration duty; an already marketed device may have a transitional period under Article 123(3)(e). EUDAMED entry is not an approval and cannot repair incorrect classification or deficient evidence.
