Eu Food Contact Compliance Consultant

Scope and evidence must be confirmed before any paid tests or filings.

An EU food contact compliance consultant should first determine what the finished article is, what food and conditions it will encounter, where it will be marketed and which operator controls the evidence. A migration report for a different product is not a regulatory strategy. The first output should be a reasoned applicability map and a list of decisions that remain blocked by missing facts.

All food-contact materials and articles placed on the EU market must meet the general safety rules in Regulation (EC) No 1935/2004 and the good manufacturing practice framework in Regulation (EC) No 2023/2006. Separate EU measures cover some categories; others also depend on national rules and substance-specific restrictions. Neither a generic EU approval certificate nor CE marking is a universal food-contact route.

Choose the legal route before ordering tests

Classify each food-contact component, not merely the retail product name. In a laminate, coating, printing ink or gasket, the identity and position of each layer can change which rules apply. The following matrix identifies the first decision, not a final legal conclusion.

What must be classified?Regulatory questionFirst strategic move
Virgin plastic food-contact layerComposition, authorised substances, food type, temperature, duration and repeated use.Assess Regulation (EU) No 10/2011 as amended, specific/overall migration, NIAS and supporting documentation; evaluate 2025/351 transition where relevant.
Recycled plastic from wasteSource of waste, recycling technology, process and decontamination information.Check Regulation (EU) 2022/1616, applicable register/process conditions and Regulation 10/2011; do not equate recycled content with approval.
Paper, board, silicone, metal or surface coatingActual food-facing surface, additives, coatings, intended EU Member States and special substances.Apply 1935/2004 and GMP; screen specific EU measures and destination-country provisions rather than assuming one EU-wide positive list.
Ceramics, regenerated cellulose, active/intelligent materialExact material category and functional feature, including release/absorption claims.Check the relevant EU-specific measure plus general rules; assess whether substance-level or special documentation provisions apply.
Multimaterial finished articleLayer order, inks, adhesives, barriers, converted article and foreseeable contact.Map each component, interface and migration pathway before deciding the plastic-specific and any national evidence route.

What information changes the regulatory answer

Before concluding that existing reports are sufficient, request the smallest factual package that allows the relevant use conditions and the supply chain to be identified. Commercial confidentiality can be handled through controlled supplier-to-assessor disclosure; an unknown formulation cannot be treated as approved.

  • Bill of materials, layer drawing and identification of food-facing parts, adhesives, inks and coatings.
  • Supplier declarations, composition/restricted-substance data and access route for confidential formulations.
  • Food types (including fatty/acidic), direct or indirect contact, time, temperature and surface-to-volume assumptions.
  • Single-use or repeated use, cleaning conditions and foreseeable misuse where relevant.
  • EU destination Member States, operator roles, manufacturing site, batches and first placing-on-market dates.
  • Existing tests, calculations, NIAS reviews, GMP records, traceability and change-history by formulation/version.

Gap triage: reuse evidence or commission new work?

Compare the applicable rule with the exact product, not with the supplier’s marketing claim. “Reusable” means evidence can still be tied to the relevant composition and use conditions; it does not mean that an old PDF automatically covers a new article.

Potential gapWhat existing evidence can establishNext controlled action
Composition or coating undisclosedA supplier statement alone may not establish which restrictions apply.Seek confidential composition review; postpone any definitive conformity opinion.
Old migration report for a related SKUReuse only if composition, geometry and worst-case contact conditions are demonstrably covered.Document equivalence and remaining gaps; scope targeted studies only if needed.
No declaration of compliance (DoC)A written DoC is required where applicable specific rules prescribe one, including plastics; it is not automatically identical for all materials.Identify the binding measure and operator, then prepare or obtain the required supporting file.
Colour, supplier or manufacturing changePrevious evidence may cease to represent the marketed article.Trigger documented change assessment and determine if re-evaluation or testing is required.

Recent changes that can invalidate an old file

For plastics, Regulation (EU) 2025/351 amended composition, documentation and verification rules. Its transitional provisions distinguish products first placed on the market before 16 September 2026 from products first placed later; qualifying earlier stocks may continue under the conditions in Article 4. The batch history and first placing-on-market date therefore matter.

Article 4(2) separately addresses intermediate-stage manufacturing products and manufacturing substances first placed on the market after 16 December 2025. If they comply with the former Regulation 10/2011 rules but not the new requirements, the accompanying DoC must state that non-compliance and that they may only be used to manufacture plastic materials and articles to be placed on the market before 16 September 2026.

Regulation (EU) 2024/3190, as corrected by Regulation (EU) 2026/250, imposes restrictions relating to BPA and certain other bisphenols in specified food-contact materials, subject to defined exceptions and transitional provisions. Do not infer that all legacy stock has the same deadline or that “BPA-free” resolves every relevant restriction. Check the current consolidated text, the material, the use and the relevant dates.

A defensible advisory sequence

The decision sequence below is an advisory workflow, not a laboratory protocol or an assertion that every product needs regulatory pre-authorisation. Escalate a novel substance or recycling route only if the applicable legislation actually requires it.

  1. Freeze a precise product/version and food-use scenario; record unresolved assumptions.
  2. Screen the framework, EU material measures, national rules and restrictions for the target markets.
  3. Map evidence to each requirement and rank missing information by safety and legal consequence.
  4. Decide whether to reuse supported data, ask suppliers, obtain expert assessment or commission targeted tests.
  5. Document the decision, ownership, recheck triggers and conditions that would reverse the conclusion.

Where strategy ends and execution starts

The advisory deliverable is a material-by-material legal route, a reasoned evidence gap register, responsibilities and a decision on whether additional assessment, supplier disclosure, tests or redesign are necessary. This is distinct from actually running migration studies or preparing a testing programme.

EU food-contact testing services; EU food-contact compliance costs.

For execution-level test selection, use the dedicated testing-services page; for quotation mechanics and budget drivers, use the separate cost page. If a national rule may apply, verify the relevant destination Member State before a final opinion. An assessment is not a regulator-issued authorisation or a guarantee of market entry.

Next action: assemble the six inputs above, flag all unresolved material and use conditions, and commission classification/gap assessment before spending on generic test panels.

Frequently asked questions

Does food-contact compliance require CE marking?

There is no universal CE-marking procedure under the food-contact framework. Another regime may apply to a particular product, but a CE mark does not replace food-contact safety evidence.

Can one laboratory migration test prove EU compliance?

Not by itself. The applicable measures, authorised substances, use conditions, NIAS, documentation, GMP and possible national rules must also be evaluated.

Can our supplier’s report be reused for a new colour or shape?

Only after a documented comparison of relevant formulation, additives, geometry and exposure assumptions. If the report does not cover the revised worst case, obtain a targeted assessment or tests.

Does every paper or silicone article need the same EU declaration?

No uniform DoC duty can be presumed for every material under the same instrument. Check material-specific EU rules, national requirements and supply-chain evidence duties.

What if plastic stock was made before the 2025 amendment?

The decisive point under Regulation 2025/351 is not manufacture alone. Verify compliance with the former rules, the first placing-on-market date and the precise Article 4 transitional conditions before relying on stock depletion.
