Product Compliance And Market Access Services In India
India does not have one universal “product approval”. The route depends on what the product does, its notified category, the Indian entity involved and the intended import or sale. This market-access map is a screening tool, not a confirmation that a specific model is approved. The routes below are illustrative, not exhaustive: products such as medicines, vehicles and hazardous industrial goods may also require separate sector-specific checks.
India applicability screen: product attributes and notified scope
Record the exact model and variants, intended use, power supply, radio functions, any patient/food contact, battery, packaging and whether the goods are imported as finished products or components. An HS code assists the customs review but does not, by itself, resolve technical coverage under a notification.
Read the current notification and its commencement, scope and exceptions against the actual product. An Indian Standard is not automatically mandatory merely because it exists: for BIS, check the applicable Quality Control Order (QCO) and its governing scheme. Separate approvals may apply to the same product.
India route-selection matrix: what to check first
| Product signal | Authority / possible route | Decision that must be verified |
|---|---|---|
| Notified electronics or IT goods | BIS — CRS, Scheme II | Exact product entry, Indian Standard, manufacturer/model and current notification. |
| Industrial goods, materials, toys or appliances named in a QCO | BIS — Scheme I (ISI), Scheme X or another scheme as notified | Precise QCO, effective date, scope, certification scheme and factory of manufacture. |
| Wi-Fi, Bluetooth or other RF transmitter | DoT / WPC — ETA, where applicable | Actual band, power and equipment category; ETA self-declaration is not a universal radio import licence. |
| Notified telecom/network equipment | TEC — MTCTE | Whether the equipment is on the notified list and which Essential Requirements apply. |
| Food or food ingredient | FSSAI | Food classification, Indian importer’s central licence and food-import clearance conditions. |
| Medical device or in-vitro diagnostic | CDSCO | Medical intended purpose, risk class and authorised agent/import licence pathway. For test or evaluation consignments, check the separate CDSCO MD-16/MD-17 route instead of assuming commercial MD-14/MD-15 applies. |
| Cosmetics and skin-care products | CDSCO — Cosmetics Rules, 2020 | Check cosmetic classification, imported product/variant/pack size and manufacturing-site registration before commercial import. |
| Energy-consuming appliances on BEE schedules | BEE — Standards & Labelling | Whether labelling is mandatory or voluntary for that category and model. |
| Batteries, listed electrical/electronic equipment or plastic packaging | CPCB / relevant EPR system | Covered stream and the correct producer/importer/brand-owner obligations; distinguish registration from product certification. |
| Pre-packaged retail goods and commercial imports | Legal Metrology; DGFT / Customs | Pack declarations/importer registration when applicable; IEC, import policy and any restricted-item permission. |
India multi-regime case: a battery-powered Wi-Fi product
A Wi-Fi-enabled, battery-powered consumer device sold in a retail box is not necessarily cleared by one certificate. First check its exact BIS CRS/QCO category; independently screen its radio interface for WPC ETA and its function against the TEC notified list. Then assess battery/e-waste and plastic-packaging EPR, applicable retail declarations, and any BEE schedule. These are screening branches, not a claim that every device needs every approval.
Do not assume foreign CE/FCC reports, a supplier’s BIS registration for a different model, or a customs HS classification replaces India-specific scope checks. For each regime record either the official basis for applicability or the reason it does not apply.
India pre-test decision file: model, factory, importer and packaging
Request the following evidence from the manufacturer and intended Indian importer. Missing information is an open classification issue, not proof of exemption.
- Product photographs, brand, all model/variant numbers, datasheet and intended-use claims.
- Bill of materials for RF modules, batteries and regulated components; frequency bands and power specifications.
- Manufacturer identity, actual factory site(s), country of origin and current certificates with their model scopes.
- Proposed Indian importer, brand owner and authorised representative/agent, with written role allocation.
- HS classification proposal, import policy check, expected import date and sales channel.
- Applicable BIS product/QCO entry, IS version, effective date and documented exceptions if claimed.
- Available laboratory reports, test methods and report-to-model traceability; do not presume foreign reports are accepted.
- Draft retail label/packaging, EPR-relevant material/volume data, and model-change history.
India import-to-sale sequence: the GO/HOLD gate
- Freeze the exact SKU, intended use and factory; distinguish components, evaluation samples and finished goods.
- Build a separate applicability line for BIS, WPC, TEC, sector regulation, EPR, Legal Metrology and DGFT import controls.
- Identify who may apply in each relevant regime; confirm the importer’s IEC and any mandatory Indian license/agent.
- Only then plan accepted testing, inspections, filings, label artwork and evidence of grant for the actual model.
- Recheck notifications and approval scope before shipment, before listing/sale and after material product or factory changes.
Decision gate: GO only when every applicable mandatory route has an identified responsible party and its required approval/compliance evidence is in place for the relevant activity. HOLD where a notification, model scope, applicant or effective date is unresolved. “No BIS required” is never a conclusion about WPC, TEC, EPR or Customs.
BIS specialist routes: CRS, ISI, advisory and testing
This page owns cross-regime triage. Once the product is routed to BIS, use the narrower page for the filing, manufacturer-specific strategy or tests:
- BIS CRS registration and submission
- BIS ISI certification execution
- BIS CRS applicability and filing strategy
- BIS CRS laboratory and testing evidence
- BIS ISI manufacturer-specific certification strategy
India shipment blockers: QCO scope, applicant mismatch and EPR portal
- Treating a tariff code or overseas certification as proof that an Indian QCO does not apply.
- Ordering tests before confirming the notified standard, accepted lab and factory/model scope.
- Using the wrong Indian applicant or ignoring a regulated imported product’s brand-owner/EPR role.
- Relying on an outdated QCO deadline or on the old CPCB plastic EPR portal: CPCB says the common EPR portal replaced it from 28 June 2026.
Questions before committing to India market entry
Does BIS registration for a Wi-Fi product replace WPC ETA or TEC certification?
No. Check BIS for the notified product category, WPC for the RF characteristics and TEC only where the equipment is notified under MTCTE. One route does not automatically discharge the others.
Can a European CE mark or FCC test report be reused?
It may inform a technical review, but is not itself an Indian approval. Acceptance of specific tests depends on the competent regime and current official rules; confirm it before commissioning or reusing tests.
Can the foreign manufacturer use its Indian distributor’s certificate?
Do not assume so. Verify the licence holder, manufacturer/factory, brand, registered models and the required Indian authorised role under each route. CDSCO medical devices, for example, have a specific authorised-agent import route.
If the HS code is unrestricted, is the product ready for sale?
No. Import policy and product safety, telecom, food/medical, packaging and EPR requirements ask different questions. Use the HS code for the trade check, then complete the separate technical and sector screens.
What if a QCO changes between testing and shipment?
Recheck the authoritative order and amendments, commencement, transitional clauses and certificate scope for the actual shipment and sale dates; put the shipment on hold if the route is uncertain.
