Eu General Product Safety Regulation GPSR Compliance Services
EU General Product Safety Regulation (GPSR) compliance services should produce a traceable launch decision for each product model—not merely a certificate or a generic checklist. Regulation (EU) 2023/988 has applied since 13 December 2024. The execution path below connects product classification, risk analysis, evidence, lab coordination, packaging, online listings and post-launch controls. The economic operator remains legally responsible for its own duties; an external coordinator does not replace it.
1. Fix the applicable route before ordering tests
Identify intended and reasonably foreseeable consumer use, sales channel, product model and the legislation covering each risk. The GPSR is central for many non-harmonised consumer goods; for goods subject to EU sector-specific rules, relevant GPSR requirements may complement those rules where risks or aspects are not covered. A product is not automatically subject to CE marking merely because the GPSR applies.
| Intake finding | Execution route | Hold point |
|---|---|---|
| Ordinary consumer item without a specific EU harmonisation route | Build a GPSR safety file and risk-based evidence plan. | Do not commission a generic “GPSR certificate”. |
| Toy, PPE or other product subject to sector legislation | Map the applicable sector rules and any complementary GPSR provisions separately. | Do not replace required sector conformity assessment with a GPSR review. |
| Battery-containing product or chemical exposure | Add the applicable battery, REACH or other product-specific checks alongside safety work. | Keep each legal regime's evidence and obligations distinct. |
| Stock reportedly first placed on the EU market before 13 December 2024 | Verify dated first-placement records and compliance with the former safety directive before considering Article 51 transition. | Do not treat a production date alone as proof of prior placing on the market. |
For an advisory-only regulatory scoping project, see GPSR consulting for consumer products. Product-specific branches such as EU battery compliance need their own evidence path.
2. Open the intake file and close data gaps
Request the inputs below by SKU/model and safety-relevant variant. The first deliverables are an intake register, responsibility map and evidence-gap list, identifying who supplies, reviews and approves each item.
- Product identification: photographs, model/SKU, materials, dimensions, version and supplier/manufacturer information.
- Intended users, foreseeable misuse, foreseeable vulnerable users, use environment and target EU markets.
- Construction drawings, bill of materials where relevant, critical components and change history.
- Existing standards assessments, test reports, certificates if relevant, incident data, customer complaints and corrective actions.
- Manufacturer, importer, distributor and any EU responsible-person arrangements, including written mandates where applicable.
- Packaging artwork, instructions, warnings, online listing drafts, traceability codes and planned distribution channels.
A missing manufacturer identity, uncertain composition or unresolved economic-operator role is a stop condition, not a box to be checked after launch.
3. Run risk analysis, standards review and proportionate testing in order
The manufacturer must perform an internal risk analysis and prepare technical documentation appropriate to the product and its hazards (GPSR Article 9, where that provision applies). Testing may be needed to substantiate the safety assessment, but the GPSR does not impose one universal laboratory test, notified-body certificate or pre-market approval procedure on every product.
- Record injury scenarios and foreseeable misuse; assess severity, likelihood and affected users, including children where relevant.
- Select relevant safety criteria and standards. For standards conferring a GPSR safety presumption, check the current Official Journal references, including Implementing Decision (EU) 2026/901 and any subsequent amendments; a standard covers only its specified risks.
- Agree a written test brief with the suitable laboratory or specialist: exact model, samples, hazards, method, acceptance criteria, report addressee and evidence ownership.
- Investigate failures, modify design or warnings where justified, document the corrective decision and retest affected characteristics before release.
- Index the final risk analysis, test reports, standards edition, artwork and version history in the model-specific technical file.
For detailed sector-specific laboratory routes rather than overall GPSR coordination, see CE safety testing in the EU.
4. Use stage gates and named hand-offs
The following is a project delivery matrix, not a statement that regulators issue approvals at these stages. Each gate has an accountable business owner and a recorded release/block decision.
| Gate | Evidence handed over | Business sign-off / blocker |
|---|---|---|
| Route agreed | Product/regime matrix and role allocation | Manufacturer/importer confirms the product and responsible operator are identified. |
| Safety demonstrated | Risk analysis, justified test scope, reports and remediation record | Manufacturer resolves material hazards and missing evidence. |
| Product and offer checked | Packaging, warnings, traceability and online-listing proofs by destination market | Relevant operator/seller corrects inaccurate or untranslated safety information. |
| Launch file closed | Indexed technical file, EU responsible-person details where required, issues register and release record | Accountable operator authorises distribution only after unresolved blockers are closed. |
5. Align physical labels and distance-sale listings
Check model/batch identification; manufacturer's name and postal and electronic contact details; importer information where applicable; and EU responsible-person identification where Article 16 requires it. Check whether instructions and safety warnings are necessary, and supply them in the language(s) easily understood by consumers as determined by the destination Member State. Permitted placement on product, packaging or accompanying document depends on the relevant provision and practical constraints.
For online or other distance offers, GPSR Article 19 requires prominent manufacturer contact information, EU responsible-person contacts if the manufacturer is outside the EU, product identification (including image/type/other identifiers) and applicable warnings/safety information. Match the exact product variant in the listing to the evidence file; a compliant box cannot cure an incomplete online offer.
6. Separate launch from mandatory incident notifications
There is no general GPSR registration, universal CE mark or routine EU approval filing required merely to sell an ordinary product under the GPSR. “Filing” in an execution plan therefore means submitting documents only where another applicable regime or a concrete notification trigger requires it. The Safety Business Gateway is used for statutory reports of dangerous products, corrective action and certain accidents, according to the operator's role and the applicable GPSR provisions (including Articles 9, 11 and 20). It is not a portal for pre-registering every safe product. Online marketplaces have separate duties under Article 22. Do not quote a uniform official filing fee or statutory approval time for GPSR-only products.
7. Keep the evidence file live after market launch
Under GPSR Article 9, the manufacturer's technical documentation must be retained for 10 years after the product is placed on the market; corresponding operator duties may differ where sector legislation governs. Assign a person to monitor the following triggers and document whether fresh review, testing, updated warnings or market action is required:
- Change of material, component, supplier, design, software or safety-relevant model variant.
- New complaints, injuries, accident reports, defects or Safety Gate signals.
- A new destination market, language, seller, importer or EU responsible-person arrangement.
- Revised standards, including later changes to the 2026/901 references, or new binding requirements.
Start the execution: provide the model/SKU list, intended users, photos, materials, existing reports, operator chain and target markets. The first decision is the route/gap register; testing and artwork can only be commissioned intelligently after that review. No coordinator can promise compliance before the evidence is examined.

FAQ: decisions before and after placing a product on the market
Is a laboratory certificate compulsory for every GPSR product?
No. The manufacturer needs a defensible safety assessment and supporting technical documentation. Select tests where product risks or another applicable law demand evidence; a voluntary certificate is not universal regulatory approval.
Can a service provider become the responsible economic operator automatically?
No. The manufacturer, importer, authorised representative and other parties have legally defined obligations. An EU responsible person under Article 16 must be identified where required; a service contract alone does not transfer every statutory duty.
Does GPSR require a CE mark or pre-market filing?
Not by itself. CE marking and any formal conformity-assessment or filing route depend on separate applicable Union legislation. Safety Business Gateway reports respond to specified safety triggers, not ordinary product launches.
Can a non-EU brand list a product online without an EU responsible person?
For a product covered by the relevant GPSR requirements, Article 16 requires a responsible economic operator established in the EU. The offer must also display the information required by Article 19. Verify the actual importer, mandate and fulfilment setup before publication.
What if testing fails or an incident arises after release?
Block the affected version and investigate the risk; correct and retest as appropriate. Where the product is dangerous or a reportable accident occurred, assess immediate corrective actions, consumer communications and Safety Business Gateway notification duties without waiting for a routine audit cycle.
Can pre-December 2024 stock be sold without the new file?
Article 51 protects continued availability of qualifying products placed on the market before 13 December 2024 and compliant with the previous directive. Keep proof of first placement and compliance; that exception does not excuse dangerous products or automatically cover new units first placed later.
