China NMPA Cosmetics Registration Filing Consultant
A China NMPA cosmetics registration and filing consultant should resolve the regulatory route before commissioning tests or preparing a submission. This is a decision audit, not a promise that every beauty product can be filed. The outcome is a reasoned classification, an evidence-gap register and a sequence of decisions the brand can approve.
First classify the product, claim and ingredient—not the marketing category
Under China’s cosmetics regime, special cosmetics require registration; general (ordinary) cosmetics require filing before marketing or import. Product function and the Chinese claims matter more than how the product is described overseas. A new cosmetic ingredient raises a separate question; it does not itself turn the finished product into a special cosmetic.
| Situation to test | Initial route | What can change the answer |
|---|---|---|
| Sunscreen, hair dye, perm, freckle-removal/whitening, anti-hair-loss, or a new cosmetic efficacy claim | Special-cosmetics registration | Exact claimed effect, formulation and category interpretation |
| A cosmetic with no special function | General-cosmetics filing | Chinese label/online claims, intended users and ingredient restrictions |
| An ingredient that may be new to China | Separate ingredient registration or filing assessment | Whether it is already covered by China’s existing-ingredient inventory and the ingredient’s function |
| Therapeutic or device-like positioning | Stop and assess the regulatory boundary | Intended purpose, presentation and evidence; do not force a non-cosmetic into cosmetic filing |
For a potentially new ingredient, use the NMPA new-ingredient rules issued as Announcement No. 59 (2026), effective 15 July 2026, instead of relying on the superseded 2021 dossier provisions.
Seven inputs that determine a defensible route
Obtain these before quoting a filing programme. A missing item should appear as an open assumption, not be silently replaced with a guess.
- Proposed Chinese and original product names, full sales copy, images and every efficacy claim—including e-commerce descriptions.
- Full quantitative formula, ingredient names, functions, specifications, suppliers and proposed safety-data access.
- Product format, application site, target age group and instructions/warnings.
- Where the final content-contact manufacturing step occurs, sites involved and contract-manufacturing relationships.
- Registrant/filer entity, quality-management arrangements and capacity to monitor adverse reactions.
- Proposed China domestic responsible person and division of responsibility with the overseas owner.
- Existing safety assessments, test reports, claim-substantiation materials and their exact product/formula versions.
Gap triage: resolve route blockers before buying evidence
This is a prioritisation tool, not an NMPA-prescribed checklist. Red items can change the pathway or make a submission unsound; amber items require a documented remedy before the filing dossier is finalised.
| Risk signal | Classification / evidence test | Pre-filing decision |
|---|---|---|
| Claim drift | Does “brightening” actually promise whitening, or do online claims promise hair-loss prevention? | Freeze or revise China-specific claims, then reclassify. |
| Formula uncertainty | Any prohibited/restricted use, missing ingredient source/safety information or possible new ingredient? | Resolve ingredient status and sourcing before commissioning final testing. |
| Safety-assessment mismatch | Is the existing assessment complete for China’s current rules and applicable submission category? | Use the appropriate current safety-assessment route; a historic simplified report is not an automatic 2026 solution. |
| Testing mismatch | Do methods, laboratory qualifications, samples and product version meet the applicable Chinese requirements? | Gap-map and commission only missing suitable tests. |
| Entity or manufacturing mismatch | Can applicant/RP obligations, manufacturing origin and entrustment records be substantiated? | Set roles and secure records before platform work. |
Evidence-reuse decision: four filters, not a blanket exemption
For every overseas dossier or sister-SKU report, mark reuse, adapt, replace or verify. The assessment is document-specific:
- Identity: the formulation, version, packaging exposure, site and claimed effect actually match the Chinese product.
- Scientific suitability: the method, study conditions, raw data and conclusions answer the relevant Chinese safety or efficacy question.
- Regulatory suitability: the China-specific testing, dossier, ingredient and safety-assessment rules are met; an EU safety report or ISO certificate is not by itself an NMPA filing.
- Control: there is permission to submit/share the evidence and a stable supplier-to-registrant information chain.
Unlike the November 2025 reform Opinions, NMPA Announcement No. 70 of 29 July 2026 is already operative. Apply its precise variant, site and document conditions to each SKU; ordinary foreign reports do not become automatically acceptable.
What the July 2026 rules change in the pre-filing decision
NMPA Announcement No. 70 took effect on 29 July 2026. Its relief is conditional and should be tested per product family, not treated as a general exemption from Chinese evidence.
| Decision point | Evidence required and safe conclusion |
|---|---|
| Sharing safety tests across variants | For the same registrant/filer and brand, only defined similar-formula products with the same dosage form and method of use can share specified tests through a representative product. Differences are limited to listed colourants, fragrance, pH adjusters, polymeric thickeners, pearlescent agents and corresponding solvent/filler adjustments. If manufacturing sites differ, select a representative for microbiological and physicochemical tests at each site; other eligible toxicology and human-safety reports may be shared. |
| Sharing efficacy-claim evidence | A separate similarity test applies and also permits preservative differences. The representative product’s claim-test data require a scientifically supported equivalence assessment for each variant. For whitening/spot-correcting, sunscreen and anti-hair-loss claims, submit the relevant test data and similarity statement with special-cosmetics registration; do not equate sharing with waiver of evidence. |
| Moving manufacturing across China’s border | Where an already registered/filed imported product switches to or adds a domestic site, or vice versa, selected original toxicology, human-safety, safety and efficacy assessments may be reused only if registrant/filer, name and formula remain the same and the executed standard is not materially changed. New microbiological and physicochemical tests and the original registration/filing proof remain necessary. |
| Ingredient safety documentation | The 2026 measure removes the requirement to enter ingredient safety files and submission codes in the registration/filing system; manufacturer identity is still entered and underlying information must be archived. Ingredient specifications or inspection reports must still be submitted if applicable technical rules demand them. This is not a waiver of ingredient safety. |
| International product launched first in China | For a qualifying international launch first in China or simultaneously with other markets, a first-launch commitment can replace evidence of prior overseas marketing and design artwork can serve as the country-of-production sales package. Confirm the actual launch scenario; other filing requirements remain. |
| Conditional exemption from toxicology reports | Announcement 70/2026 allows certain special cosmetics (perm, non-oxidative hair dye, solely physical-cover whitening) and ordinary cosmetics using a new ingredient (excluding children’s products) to omit product toxicology reports only when the manufacturer holds government-issued manufacturing quality-management qualification evidence and the product safety assessment sufficiently establishes safety. Check both conditions; this is not an automatic animal-testing exemption for all cosmetics. |
October 2026 technical changes and the 2028 standard: date the evidence before deciding reuse
NMPA Announcement 99/2026 addresses amendments to the Cosmetics Safety Technical Specification. For an existing registration/filing, compare the actual amendment and its implementation date with formula, label, microbiological/harmful-substance limits and methods. Compliant old data may allow a standards update with records kept; a failed comparison can require fresh testing, safety work and a change application. For a proposed submission, tests started before the relevant amended provision takes effect may remain usable under this notice. This is a conditional transition, not unlimited acceptance of old reports.
The mandatory national standard GB 7916—2026 was published in 2026 but takes effect on 1 January 2028, replacing GB 7916—1987 then. Do not present it as already in force in October 2026. Include an implementation-date column in the gap register, especially for planned formula and packaging changes, and evaluate the currently applicable specifications separately.
Decision gates before execution
- Gate 1 — scope: decide whether the product is a cosmetic and whether special function or a new-ingredient workstream is implicated.
- Gate 2 — claims: approve the China-specific claim and label concept; changes here can overturn the route.
- Gate 3 — formula: complete ingredient and safety-information screening; flag any unresolved supplier data.
- Gate 4 — evidence: approve a gap register showing reusable materials, adaptation needs and tests still required.
- Gate 5 — governance: agree registrant/filer, domestic RP, data access, post-market monitoring and change-control ownership.
- Gate 6 — execute: only then commission final testing and instruct dossier submission under the confirmed pathway.
Domestic responsible person and later changes: a strategy choice
An overseas registrant/filer must designate a legal-person enterprise in China as domestic responsible person. That role handles procedures on its behalf and supports adverse-reaction monitoring, recall and regulatory inspection; the overseas registrant/filer retains statutory quality and safety responsibility. Check contract duration, platform and dossier access, supplier-data confidentiality, handover and exit rights before appointment. Formula, efficacy-claim and address changes must be assessed for controlled updates or re-filing under the applicable rules; substitution of the domestic responsible person has its own documented change procedure. Special cosmetics have distinct change rules.
Under Announcement No. 70 (2026), replacing a domestic responsible person no longer requires the former responsible person’s stamped consent. The listed change materials include an original notarised new authorisation, a product list and the incoming responsible person’s undertaking for existing obligations. Plan handover and evidence access; this is not a no-document change.
What a useful consultant’s strategy memo delivers
Ask for a signed-off product-by-product route matrix, citation-backed classification rationale, red/amber gap register, evidence-reuse decisions, a responsible-party map and a decision-gated budget covering remaining tests and filing work. Treat lead times and laboratory charges as provisional until the route is fixed. Detailed platform steps and submission logistics belong to the separate China NMPA cosmetics registration and filing service page. Where product claims instead suggest a medical device, consult the separate China NMPA medical-device classification advice rather than applying cosmetic rules by analogy.
Questions to settle before a consultant files
Can a “brightening” serum be treated as general cosmetics?
Not from that word alone. Examine the exact Chinese claim, supporting evidence and whether its real meaning is spot removal or whitening. Do not order general-cosmetic tests before deciding the claim.
If my ingredient appears on an overseas INCI list, is that enough?
No. Check its status, function and restrictions under the Chinese ingredient regime; a potentially new ingredient requires a separate assessment. INCI nomenclature is not proof of Chinese eligibility.
Can I reuse my EU safety assessment and test reports?
They may be useful inputs but are not automatically sufficient. Compare product identity, China-specific methods and data quality, safety-assessment format, and rights to use the records.
Can an agent file without a Chinese domestic responsible person?
For an overseas registrant/filer, the designated Chinese legal-person domestic responsible person is a statutory role. A commercial consultant is not automatically that person; check the actual appointment and obligations.
Can shades or related SKUs share NMPA tests under the 2026 rules?
Sometimes. Announcement No. 70 allows specified safety and efficacy evidence to be shared for the same registrant/filer and brand when the relevant, distinct similar-formula criteria and scientific assessments are satisfied. Microbiological and physicochemical testing remains site-specific; special efficacy claims may require accompanying data at registration.
Does Announcement 70/2026 eliminate animal tests for my product?
No blanket exemption. Certain specified products may omit a product toxicology report only with qualifying government-issued manufacturer quality-system documentation and a safety assessment that sufficiently confirms safety. Children’s ordinary cosmetics using a new ingredient are excluded from that route. Determine eligibility product by product.
