Thailand FDA Product Registration Consultant

Scope and evidence must be confirmed before any paid tests or filings.

A Thailand FDA product registration consultant should first answer which legal product route applies—not simply promise an FDA number. Thai FDA supervises distinct regimes for foods, cosmetics, medical devices, medicines, herbal products and certain hazardous substances. The correct strategy depends on intended use, claims, ingredients, mechanism, applicant and whether the goods are for commercial import, manufacturing, research or personal use. This is a pre-filing decision framework, not a substitute for an authority determination.

Define the decision before commissioning work

At the outset, record three decisions separately: the likely regulatory family, the legally eligible Thai-side applicant or operating facility, and the authorization(s) needed before the proposed commercial activity. Do not price laboratory testing or promise a filing date while any of these is unresolved. A consultant can provide a reasoned preliminary opinion; where classification remains genuinely uncertain, a Thai representative can seek the FDA’s official e-Consult classification service.

Route-selection matrix: what changes the filing path

Use the following as triage—not as a definitive classification of a particular SKU. The same marketing name can lead to different outcomes once composition and claims are reviewed.

Possible familyFacts to verify firstStrategic route implication
Food, including supplementsFormula, dose, consumption form, nutrition/health claims, sale versus other purpose.Food import premises licensing may be needed; whether a product serial number is required depends on its food category. Some general foods follow the Virtual Number route rather than a food serial number.
CosmeticSite of application, primary beautifying/cleansing function, all ingredients and disease-treatment claims.Check cosmetic notification and responsible manufacturer/importer plus facility information; do not treat notification as drug approval.
Medical device or IVDIntended medical purpose, mode of action, invasive/use duration, sterility, IVD status and accessories.First establish device status, then risk class 1–4 and applicable listed/notified/licensed route; importer/manufacturer establishment registration is a distinct issue.
MedicineTherapeutic indications, active substances, presentation, whether finished drug, sample or trial supply.Assess drug-facility and drug-product routes; finished products for general sale are subject to product registration, with special routes for stated non-sale purposes.
Herbal productPlant/extract identity, formulation, claimed purpose, dose and manufacture/import model.Use the herbal-product classification and risk review; evaluate premises and any sample/analysis permission before a product submission.
FDA-controlled hazardous substanceActive ingredients, concentrations, use (such as insect control or disinfecting), and listed substance type.Type 1 declaration and type 2/3 registration or facility controls differ; verify the applicable list and exceptions, not just a generic “FDA certificate”.

High-risk hazardous-substance stop check: verify the current Thai FDA-controlled hazardous-substance list and the responsible authority before considering a registration. For FDA-controlled substances, Type 1 requires a product-details declaration; Type 2 and Type 3 generally require product registration, subject to specified exceptions. Separately, operating-activity notification applies to Type 2 whereas an activity licence is required for Type 3. Type 4 is generally prohibited from manufacture, import, export, transit or possession, save a narrowly defined laboratory-reference authorization. An ordinary product-registration plan is not an alternative for Type 4.

Device-classification fork: apply the ASEAN Medical Device Directive Annex 2 rules to non-IVD devices and Annex 3 rules to in-vitro diagnostic devices. Both feed the Thai risk-based route, but an IVD must not be classified solely using a non-IVD device checklist.

A classification file that can withstand scrutiny

Create a frozen product profile for each formulation and intended use. The most consequential missing data are:

  • Full quantitative formulation, including active ingredients and plant species/extract specifications where relevant.
  • Intended user, body contact or consumption route, claimed purpose, instructions, advertisements and exact Thai-market wording.
  • Mechanism of action and technical description for devices; clinical or analytical purpose, whether IVD, and accessory role.
  • Manufacturing sites, quality-system evidence, sterilization or special-process information where relevant.
  • All sales channels, import purpose, proposed Thai importer/license holder, premises and distributor arrangements.
  • SKU variations: formulation, strength, pack, brand, IFU, label, intended use or manufacturer differences.

The classification memo should state a proposed route, the official rule/page used, contrary indicators, facts still missing and whether an official classification request is needed. A foreign certificate or customs code alone does not establish Thai FDA classification. The Thai medical-device risk self-check tool is preliminary and is not an official classification certificate.

Applicant, establishment and shipment are separate gates

For commercial imports, do not confuse product authorization with authority to operate or to clear shipments. Thai FDA guidance addresses the local food importer’s Thai place of business; medical-device commercial manufacture/import requires establishment registration as well as the device authorization appropriate to its risk classification; cosmetic notifications identify the manufacturer or importer. The official import-for-sale guidance also describes per-invoice LPI and customs/checkpoint steps for covered imported products. The responsible local party must therefore be verified for the particular regime, rather than assuming that an overseas brand can file directly or that a consultant’s appointment automatically makes it eligible.

Check the purpose-specific medical-device exceptions separately: Thai FDA identifies defined situations involving samples, exhibitions, research, individual patients and personal use in which the usual establishment and product permissions do not apply. These are not exemptions for subsequent commercial sale, and they do not establish that a shipment can bypass all import formalities. Record the quantity, recipient, intended use and the exact provision or permission relied on before dispatch.

Import-source conflict to resolve: the Thai-language FDA checkpoint instructions dated 21 February 2025 describe LPI for each commercial herbal-product import, whereas an older English FDA import summary narrows the LPI note for herbal goods. Before shipping, ask the responsible Thai importer/checkpoint to confirm the current requirements for the actual herbal authorization and shipment; do not infer an LPI exemption from the older English page.

Foreign evidence: reuse only after a relevance check

Existing foreign material can reduce preparation work, but “approved elsewhere” is not a universal Thai exemption. Record ownership, product identity, version, language, scope and any changes before marking evidence reusable.

Existing materialPotential useHold point / gap
Foreign product approvalsRegulatory history and, for devices, possible support for an eligible abridged or reliance pathway.Check the Thai FDA route’s stated reference-jurisdiction conditions, same device/version and required authorization documents. No automatic recognition.
EU/US technical file, ACTD/CTD or device dossierSource for formulation, risk, quality, safety, performance and manufacturing evidence.Map each item to the Thai category-specific dossier; country-specific sections, language and completeness may differ.
GMP/QMS certificates and factory informationCan inform applicable premises/manufacturer quality review.Verify accepted scope, site, product family, recency and whether further local evidence is required.
Laboratory, stability, clinical or performance reportsPotential support for product-specific technical requirements.Check methods, samples, claims, validity and Thai dossier requirements before ordering repeat tests.
Artwork, instructions, advertising claimsEvidence of actual intended use; starting point for local label review.A claim or formula revision may change classification and create a new evidence or approval issue.

Priority gap analysis and spending gates

Run a stop/go review in this sequence. These are consultant project controls, not statutory Thai FDA filing stages or guaranteed regulator timelines.

  • Gate 0 — Classification: no paid category-specific testing or dossier compilation until the proposed route and disputed claims are documented; escalate ambiguous products through official classification advice.
  • Gate 1 — Responsibility: verify Thai applicant, premises/importer permissions, authorization from manufacturer and who owns regulatory communications and approvals.
  • Gate 2 — Evidence: map existing documents to each Thai requirement; flag missing tests, dossier sections, translations, product-grouping and claim/label conflicts.
  • Gate 3 — Sequence: budget only confirmed gaps, set dependencies for sample imports and approvals where needed, then decide whether to authorize filing execution.
  • Gate 4 — Change control: monitor formula, claim, site, importer, labeling and device-intended-use changes before and after approval.

Three borderline scenarios worth resolving early

Illustrative risk screens; none can be classified conclusively from the short description:

  • Herbal throat lozenge: obtain dosage, full formulation and all proposed claims. Plant content does not by itself establish the herbal rather than food or medicine route; suspend label printing until the claim boundary is resolved.
  • Skin cream promoted as treating infection: obtain ingredients and full promotional material, not only a cosmetic-style pack. The therapeutic claim may undermine an assumed cosmetic route; seek regulatory classification before notification.
  • Sensor marketed for monitoring a medical condition: document intended medical use, measuring function, patient population and accompanying software. A foreign device listing does not select the Thai risk class or dossier pathway.

What a useful consultant should deliver

A useful advisory engagement produces a dated classification rationale with source links; a branch-by-branch permit map for the selected use; a Thai applicant/responsibility diagram; a document-reuse and missing-evidence ledger; a prioritized test/translation/filing dependency plan; and a written uncertainty register identifying matters requiring regulator confirmation. Ask whether the adviser is giving strategy, acting as authorized local applicant, conducting submissions, or engaging a laboratory: these are distinct scopes. No adviser can guarantee an approval, fixed duration or acceptance of foreign records.

First-consultation document pack

Provide: product brief and pictures; complete formulation or technical specification; labels, instructions and all draft claims; intended use, target users and sale channel; manufacturer/site details and foreign certificates; test reports and approvals already held; SKU/variant list; planned Thai importer or distribution model; and launch constraints. If confidential ingredients cannot initially be disclosed, flag them as unresolved: classification will remain provisional.

Where advisory strategy stops and execution begins

This page owns the pre-filing regulatory strategy. For Thailand-wide product compliance outside Thai FDA, see Thailand market-access overview. For detailed medical-device submission handling, see medical-device submission workflow. For medical-device registration cost drivers rather than route determination, see medical-device cost assessment. These are separate tasks: a strategic route memo is not a completed application, establishment license or customs clearance.

Frequently asked questions

Can US FDA clearance, CE marking or an ASEAN authorization replace Thai FDA registration?

Do not assume so. Existing approvals can support regulatory history or a specifically eligible device abridged/reliance route, but each Thai pathway has its own conditions. Confirm identical product scope and the current Thai FDA instructions first.

Is every food import required to carry a Thai FDA food serial number?

No. Thai FDA guidance distinguishes foods requiring a food serial number from certain general foods handled without one using the Virtual Number System. Commercial import licensing and other controls still need assessment.

Who should seek classification when my product crosses cosmetic and medicine claims?

First prepare a complete formulation, use statement and exact label/advertising claims. A representative in Thailand may request official product classification through the Thai FDA e-Consult service. Do not file based only on the product’s marketing category.

Can we commission Thai laboratory tests before appointing an importer?

You can plan evidence needs, but should not order category-specific tests without settling the route and checking whether sample-import permission or an appropriate Thai-side applicant is required. Existing valid reports should be mapped before retesting.

If we change a formula, manufacturer or medical intended use, can we rely on the old strategy?

Not without re-screening. Such changes may alter classification, dossier evidence, responsibility or post-approval variation duties. Record the exact change and assess the applicable Thai rules before further sale/import.
