Brazil Anatel Telecom Certification Consultant
A consultant should resolve the certification route before anyone orders tests
A Brazil ANATEL telecom certification consultant adds value before filing: determine whether the exact product is in ANATEL’s scope, identify the applicable technical acts and conformity-assessment model, check who may be the Brazilian applicant, and decide which existing evidence can legitimately support the file. A laboratory quotation alone cannot settle those questions.
Under Resolution 715/2019, as amended by Resolution 780/2025, conformity assessment and ANATEL homologation are distinct. A certificate from an ANATEL-designated certification body (OCD) is not itself the ANATEL homologation. The technical requirements for the product family determine which route applies; never infer it solely from the words ‘Bluetooth’, ‘Wi-Fi’, ‘CE’ or ‘FCC’. S1 S2 S3
Define the product and intended Brazilian use
Prepare one SKU-by-SKU fact sheet. The minimum strategic inputs are:
- Exact marketed brand, model/SKU, hardware revisions, PCB, antenna and radio-module identities.
- All radio interfaces, bands, output power, firmware-controlled regional settings and operating modes.
- Power source, mains connection, accessories, batteries and chargers, including what is supplied in the box.
- Function and network connection: end-user device, telecommunications-network element, passive accessory or mixed-use equipment.
- Commercial plan: sale, marketplace listing, integration into another product, operator deployment, or genuinely personal import.
- Manufacturer, factory sites, intended applicant/holder in Brazil, existing approvals and anticipated variants.
The presence of a radio is a strong screening signal, not a complete legal classification. ANATEL also lists non-radio network equipment, cables and certain accessories. Match functions and construction to the current family scope and technical acts; flag uncertain classifications for an OCD or ANATEL rather than labelling them exempt. S3 S4
Route-decision matrix: which question changes the answer?
| Product scenario | Strategic route hypothesis | Decision still required |
|---|---|---|
| Wi-Fi/Bluetooth end product for Brazilian retail | Presume an ANATEL scope review and usually an OCD-led certification route before homologation. | Confirm family-specific technical acts, tested configuration and Brazilian holder; do not treat module reports as automatic host approval. |
| Network switch, optical terminal, cable or accessory | Do not apply a radio-only filter; network elements and relevant accessories can be in scope. | Match exact type to ANATEL’s current scope list; separate telecom rules from other product rules. |
| Battery-powered wireless unit imported solely for own use | A unit-specific Declaration of Conformity may be possible under narrowly defined conditions, not for resale. | Confirm device category, serial number, private-use purpose and exclusion from telecom-service provision; foreign approval can support the file only where ANATEL accepts it. |
| Existing homologated model under new importer, label or firmware | Check certificate holder, covered model identifiers, rights and technical differences first. | Determine whether holder authorization, formal transfer/new homologation or reassessment is required; no automatic reuse. |
| Data-centre facility associated with a telecom network | Do not assume the 2025 data-centre provisions presently impose a live approval duty. | ANATEL Acórdão No. 58 of 3 March 2026 suspended the enforceability of the effects of Resolution 780/2025, Article 6, pending reconsideration; check current status and distinguish the facility from its telecom equipment. |
This matrix is a triage tool, not a binding ruling. For commercial products, the conformity model must be checked against the specific technical requirements. ANATEL’s declaration routes are not a universal short-cut around an OCD. S1 S2 S5
Commercial-route safeguard: ANATEL’s current Certifica manuals distinguish OCD-issued technical conformity certificates from expressly available declarations of conformity for commercialization. A sale plan does not, by itself, prove that every product must use an OCD or that a declaration is available. Determine the model from the applicable technical act before commissioning tests or preparing a marketplace listing. S1 S10
Own-use uncertainty to resolve: ANATEL’s general FAQ still describes a Category II / no-continuous-mains-power limitation for an own-import declaration, while the separate own-use overview revised on 8 October 2026 no longer repeats that limitation. Omission is not proof of repeal or eligibility: ask ANATEL to confirm the exact category, power configuration and evidence route before importing. The manuals also distinguish specific own-use requests associated with telecommunications-service provision in Certifica; those are not interchangeable with the serial-number-specific, non-commercial own-use route. S4 S5 S9
Evidence-reuse gap analysis: accept, adapt or retest?
Review existing evidence line by line against the Brazilian rule, not by logo on the certificate:
| Evidence offered | Consultant’s verification | Gap outcome |
|---|---|---|
| FCC/CE or overseas RF reports | Compare exact SKU, antenna, radio modes, frequencies, power, lab scope, report age and ANATEL limits. | Potential technical input; never automatic Brazilian homologation. |
| Certified embedded radio module | Check host layout, antennas, firmware restrictions, final-product functions and applicable product scope. | May narrow tests only if an OCD accepts the equivalence for this configuration. |
| Earlier ANATEL record or certificate | Check holder, identifier, covered variants, certificate/homologation status and maintenance conditions. | Use only within confirmed coverage; changed product or rights may need new action. |
| Safety/EMC/battery reports and factory QMS | Map to current Brazilian methods, samples, manufacturing site and any factory-assessment model. | Mark reuse conditional, required supplements, or missing assessment. |
| Manuals, photos, labels and declarations | Check model consistency, user restrictions, identification and applicant authorization. | Identify documentary corrections before sample shipment. |
Give every row an evidence owner, source version and one disposition: confirmed relevant; potentially reusable subject to OCD review; missing; or incompatible. This is a planning classification, not a regulatory acceptance decision. Do not promise recognition of foreign tests without written route confirmation. S1 S3
Secure the Brazilian holder and accountability chain
Under Article 20 of Resolution 715, except for expressly specified cases, homologation requests must be made by an adult resident in Brazil or a legal entity established under Brazilian law, with eligible manufacturer/representative/own-use categories. The applicant’s legal standing, manufacturer's authorization where required, consumer obligations and product-holder rights must be resolved before committing to samples. A foreign vendor’s consultant is not automatically the legally eligible holder. S1 S4
Separate four roles in writing: manufacturer (technical control), Brazilian applicant/holder (legal accountability), OCD (independent certification in an OCD route), and testing laboratory (test evidence). ANATEL alone issues homologation. A party that consulted on development must also consider the independence limits for the chosen OCD under Article 37. S1 S6
- Identify the exact Brazilian applicant, registration details and basis of eligibility.
- Obtain and scope any manufacturer authorization and distribution/holder agreements.
- Check who controls certification maintenance, product changes and consumer support.
- Verify OCD designation and its specific scope for the product family.
Five decision gates before testing or filing
- Gate 1 — freeze product configuration and intended commercial or own-use purpose; escalate ambiguous scope.
- Gate 2 — identify current product-family technical requirements, conformity model, import and labeling conditions. S8
- Gate 3 — validate Brazilian applicant/holder rights, OCD scope and any conflicting roles.
- Gate 4 — run report-to-rule gap analysis; only then agree lab scope, representative samples and documentation plan.
- Gate 5 — authorize execution only against a route memo listing open issues, decision owners, evidence gaps and change triggers.
Since 8 September 2026, Certifica has handled the supported new certification and homologation procedures, and SCH no longer accepts new requests. Do not assume every own-use declaration goes through Certifica: ANATEL’s updated 8 October 2026 manuals direct some own-use categories to SEI and others to Certifica. Select the channel by the exact declaration category and current official manual, not an old SCH guide. S7 S9
Risk triggers to keep the chosen route valid
Stop and reassess when the antenna, frequency bands, RF power, hardware, firmware, factory, model name or holder changes. Articles 48–50 provide for notification and impact evaluation under applicable technical requirements, not an assumption that every change is harmless or always requires identical retesting. Certification maintenance depends on product-specific requirements; an ANATEL homologation certificate normally has no fixed end date unless a technical rule provides otherwise. S1
Sales-channel planning is also regulatory planning. Resolution 780/2025 extended obligations concerning noncompliant listings and homologation-code disclosure to marketplaces and other digital platforms; a strategy memo should therefore verify product/code consistency before advertising. The 2025 special data-centre provisions must not be described as operative without checking the March 2026 suspension. S2
The pre-execution decision memo to request from a consultant
- Applicability conclusion with an explicit confidence level, unresolved classification facts and citations to current ANATEL acts.
- Route and responsible-party map: OCD certification or supported declaration model, holder, required approvals and decision owner.
- Evidence-reuse ledger showing each report, matching configuration, gap, supplementary test question and reviewer.
- Sequenced go/no-go plan with dependencies, change-control triggers and separate estimates for OCD, lab and advisory work.
ANATEL issues the homologation certificate free of charge under Article 58, but this does not mean an OCD, laboratory, sample transport or consultancy is free. Do not promise an approval date, a total price or an exemption without the SKU-level review. S1
Where the strategy hand-off ends
Once the classification and gaps are settled, use
- ANATEL certification services — for application and certification delivery,
- ANATEL testing services — for laboratory, sample and retest execution,
- INMETRO certification consulting — if another Brazilian certification regime may also apply,
- Brazil product market access overview — for the broader Brazilian market-entry map.
An ANATEL route assessment does not replace a separate INMETRO, ANVISA or other applicable review; neither does another regime replace ANATEL where its own scope is met.
Questions that affect a real advisory decision
Can a CE or FCC certificate replace ANATEL approval for a retail Wi-Fi product?
No automatic replacement. The adviser can compare overseas reports with current Brazilian acts, but ANATEL homologation and the applicable conformity model remain separate requirements; decide accepted evidence with the OCD where relevant.
Does an already approved Wi-Fi module exempt the assembled host?
Not on that fact alone. Provide host antennas, PCB/layout, software, operating bands and the module record; determine final-product scope and any accepted evidence reduction before testing.
May my overseas company file without a Brazilian certificate holder?
Do not assume so. Resolution 715 Article 20 sets eligibility and ordinarily requires a resident individual or Brazilian legal entity, subject to express exceptions. Check who is legally entitled to request and hold the relevant approval.
Can I use the personal-import declaration for devices sold on a marketplace?
No. An own-use declaration covers the identified unit, not resale. Check the applicant’s actual purpose, the product category and its eligibility under ANATEL’s current own-use rules; use in telecommunications-service provision calls for a different assessment.
What if the product is approved but the antenna or firmware changes?
Disclose the exact change to the responsible OCD or ANATEL as appropriate. The applicable technical act determines impact assessment, evidence and whether new conformity actions are necessary.
