Product Compliance And Certification For Electronic Equipment EPR In Spain
Selling a powered product in Spain is not a single “EPR certification” exercise. Waste electrical and electronic equipment (WEEE/RAEE) producer registration, EU product-conformity rules, packaging obligations and any battery obligations answer different questions. Apply the matrix to the actual model, seller and sales channel; CE marking does not replace waste-producer registration.
Classify the electronic product before choosing registrations
- Ask whether the finished item needs electricity or electromagnetic fields to perform its intended function. Royal Decree 110/2015 defines electrical and electronic equipment (AEE) within stated voltage limits and supplies exclusions. Record the function, rated voltage, configuration and any claimed exclusion; “professional use” alone is not an exclusion.
- Classify each in-scope AEE into Annex III categories (for example temperature-exchange equipment, screens, lamps, large equipment, small equipment, small IT/telecom or photovoltaic panels). Record both weight and units and whether the end-of-life stream is household-like or genuinely professional; equipment usable in homes and businesses may count as household WEEE.
- Identify separately: whether the product has radio (Wi-Fi, Bluetooth, cellular), a mains adapter or other voltage profile, an included or embedded battery, and which retail, transit and e-commerce packaging enters Spain. A bare component, refurbished unit or industrial installation requires a facts-based scope decision, not an automatic exemption.
Spain electronic-equipment compliance: six-layer decision matrix
| Regulatory layer | Trigger for this SKU | Decision / evidence to secure |
|---|---|---|
| WEEE / RAEE | Finished in-scope AEE placed on the Spanish market | Identify Spanish AEE producer, Annex III category, household/professional use, RII-AEE registration number, compliant individual/collective waste scheme and quarterly units/weight records. |
| CE + EMC/LVD/RED | Equipment covered by relevant EU harmonisation rules; radio changes the route | Check each directive and exemptions; perform the applicable conformity assessment, retain technical file and EU declaration, and apply CE only where required. Radio equipment requires a RED-specific analysis, not an automatic EMC-plus-LVD duplicate route. |
| RoHS | EEE within the substances-restriction scope | Verify restricted-substance evidence for relevant materials/components, scope and any specific valid exemption under Royal Decree 219/2013. A supplier declaration alone may not establish the finished model’s compliance. |
| Packaging EPR + PPWR | Sales, transport or delivery packaging introduced into Spain | Identify packaging producer and authorised representative where applicable; check Spanish packaging register / EPR system, material weights and recycling labels. Also review EU Regulation 2025/40 applicable since 12 August 2026 and its phased provisions. |
| Battery regime | Battery included with or incorporated in equipment | Separately determine the battery producer and duties under Regulation (EU) 2023/1542 (Chapter VIII effective from 18 August 2025); reconcile with Spanish implementation. WEEE registration alone does not discharge battery EPR. |
| Other product-specific rules | Specific types: e.g., covered energy-related products, chargers or regulated devices | Test the model against applicable ecodesign, energy-labelling and specialist safety rules. Do not infer these requirements for every electronic item. |
For an internet-connected or other potentially covered radio model, assess the RED cybersecurity requirements triggered by Delegated Regulation (EU) 2022/30 from 1 August 2025: network protection, privacy/personal data and fraud protection apply by equipment category and function, not to every radio device. Regulation (EU) 2026/339 repeals that delegated regulation only from 11 December 2027, when the Cyber Resilience Act’s principal obligations begin. Identify the marketed hardware/software configuration and the applicable conformity-assessment route; a Wi-Fi module certificate alone cannot settle the finished product’s obligations.
Which company carries each Spain EPR obligation?
- Spanish own-brand manufacturer or first importer: test whether it is the WEEE producer under Article 3(h), not merely the customs declarant or warehouse operator.
- Foreign direct-to-Spain online seller: Article 3(h)(4) includes distance sellers; an EU-based seller in another Member State appoints an authorised representative in Spain under Article 3(j). For third-country structures, confirm the valid Spanish registration/representation route rather than assuming the EU case applies word for word.
- Distributor or marketplace: verify the actual RII-AEE producer ID and channel documentation; a platform’s packaging role cannot automatically be used as proof it has assumed WEEE obligations.
- Packaging can have a different liable producer: under Article 17(2) of Royal Decree 1055/2022, non-Spanish producers selling packaged products into Spain appoint an authorised representative, with subsidiary responsibility rules if absent. Allocate the packaging and AEE roles separately in writing.
- Before listing a model sold by a distributor, verify the producer’s RII-AEE number: Article 11 of Royal Decree 110/2015 prohibits distributing AEE from unregistered producers. For household WEEE, a distance-selling distributor must arrange free take-back of equivalent discarded equipment at delivery or the buyer’s home under Article 22(4). Do not generalise this specific household collection rule to every professional B2B device; the producer’s registration does not replace an applicable distributor take-back duty.
- Transport-packaging responsibilities have two distinct cases under Article 17(5) of Royal Decree 1055/2022: (a) a courier or parcel company that provides distance-sale transport packaging fulfils the specified financing and information duties, and organisational duties where applicable, on behalf of the producer of the packaged product; (b) an e-commerce platform facilitating a third party’s sale of packaged goods has the corresponding duties for transport packaging used in those sales. Do not assume the platform must itself supply the packaging to trigger case (b). Check the actual transaction, packaging flow and contractual evidence; neither case automatically transfers WEEE producer duties for the device.
Model-level evidence file: what to request before launch
- SKU sheet: model, intended use, rated voltage, radios, battery chemistry/configuration, adapter, product photos, units and net product mass.
- CE dossier: applicable-law assessment, test/risk reports appropriate to EMC, safety and radio, RoHS material evidence, technical documentation, EU declaration and traceability/instructions.
- WEEE docket: rationale for scope/category and household/professional status, RII-AEE ID, EPR participation, quarterly quantities/weights and invoice or online-sales number placement.
- Packaging ledger: retail carton, inserts, film, shipping box and protective filler by material, weight, origin, producer and Spanish packaging-register/scheme evidence.
- Battery branch (if present): battery type, identity of its producer, applicable registration/EPR evidence and any separate marking/information or product-design checks.
- Version log: supplier changes, radio firmware, power supply, packaging redesign, brand or sales-channel change; assign an owner to reopen the applicability check.
- For radio SKUs, add supported frequency bands, power, final firmware/software configuration, Spanish-language instructions and the relevant RED cybersecurity analysis; for e-commerce, document the distributor’s like-for-like WEEE take-back arrangements and the responsible party for courier-supplied parcel packaging.
Three equipment bundles that change the route
| Example SKU | Most important split | Cannot conclude without |
|---|---|---|
| USB-powered Wi-Fi sensor in a cardboard retail box | AEE/WEEE + radio conformity + RoHS + packaging; battery branch only if supplied/included. | Radio bands and use, product classification, actual seller, packaging mass and registration evidence. |
| Corded kitchen appliance sold with parcel packaging | AEE/WEEE + electrical safety/EMC/RoHS as applicable + retail/delivery packaging. | Rated voltage, design/test file, household WEEE treatment and who introduces each pack. |
| Industrial control module mounted in a large installation | Check whether it is independent AEE or an expressly excluded specific component; determine EMC/other product rules and any packaging. | Standalone function, installation integration, replacement design and exact exclusion facts. |
Labels, sales listing and launch gates
- On the device: WEEE crossed-out wheeled-bin mark and post-2005 identification under Article 7 of Royal Decree 110/2015, with narrow placement exceptions; review CE, manufacturer/importer and radio markings under the product-specific rules.
- For distance sales made by the AEE producer, Article 9 requires that producer’s RII-AEE number on the online selling medium and the user invoice (subject to its public-administration Facturae exception). A distributor who is not the producer must be able to give the producer’s number when asked; the Spanish ministry’s RII-AEE FAQ distinguishes this from the producer’s own online-display duty. Producer–distributor invoices have a separate Article 9 rule.
- On packaging: determine the Spanish domestic disposal-fraction information required by Article 13 of Royal Decree 1055/2022, applicable PPWR rules and restrictions on environmental claims; do not confuse packaging symbols with WEEE marking.
- Release sequence: (1) freeze model and responsible parties; (2) resolve category/exception and conformity route; (3) obtain WEEE, packaging and battery registrations/scheme evidence as applicable; (4) approve device, pack and listing artwork; (5) start sale only after the applicable gates are met and maintain reporting.
- Timing matters: the Spanish domestic-packaging sorting-fraction indication under Article 13(2) has applied since 1 January 2025. The PPWR harmonised material-composition label under Article 12(1) does not generally start on 12 August 2026: it starts from 12 August 2028 or 24 months after the relevant implementing acts enter into force, whichever is later, subject to scope exclusions. For applicable radio-device categories, separately check charging-device pictograms and distance-sale price-page disclosures under Spain’s radio rules.
Packaging artwork needs a future-change checkpoint: the Commission’s June 2026 non-binding interpretation of PPWR Article 12 expects national consumer-sorting labels not to remain alongside EU-harmonised labels after the relevant harmonised-label commencement date. For a long-lived electronic SKU, recheck the implementing acts and Spain’s applicable rules before reprinting; this guidance is not itself a new legal obligation.
Avoid these classification and change-control failures
- Do not treat a CE test report, voluntary “certificate” or EU declaration as an AEE registration number: they serve different legal purposes.
- Do not conclude “small volumes” exempt WEEE registration or packaging EPR. Spanish simplified packaging reporting for certain quantities is not a general producer exemption.
- Do not reuse France’s WEEE/EPR identification or a battery producer ID as Spain’s RII-AEE number; separate national records and materials may be needed.
- When a radio module, battery, adapter, manufacturer, packaging or distribution model changes, reassess conformity and EPR identities; the prior file may no longer describe the sold SKU.
For embedded or bundled batteries, consult the dedicated Spain battery EPR product route. For cross-border comparison, see the France electronic-equipment route; it is not a substitute for Spanish registration.
Five electronic-equipment EPR questions
Can I sell CE-marked electronics in Spain without RII-AEE registration?
CE conformity and WEEE producer registration are independent. If the SKU is in scope and you are the responsible AEE producer, resolve RII-AEE registration and EPR financing before sale.
Does an electronic device with a built-in battery need two EPR routes?
Potentially yes: check AEE/WEEE and battery EPR separately, plus packaging. Establish who first places each regulated object on the Spanish market and prevent double-counting of waste costs.
Is B2B industrial electronic equipment outside Spain WEEE?
Not automatically. The regime includes professional AEE; exemptions for specific large fixed installations or purpose-built components require supporting design and installation facts.
Does a foreign marketplace or fulfilment agent become the producer?
Not merely by shipping or listing an item. Classify the actual parties under each regime, including distance-selling definitions, authorised representation and any packaging-platform fallback.
What changed for packaging in August 2026?
Regulation (EU) 2025/40 began applying on 12 August 2026, with provision-specific transition dates. Review its current requirements alongside Spanish packaging registration and EPR duties; do not assume every new marking starts that day.
