EU Battery Regulation compliance consultant: choose the right route before testing

A compliance consultant should resolve the legal route, not simply sell a laboratory package. Regulation (EU) 2023/1542 covers batteries sold separately and batteries incorporated into equipment or vehicles. The right plan depends on the battery’s intended use, your commercial role, the date of placing on the market and the evidence already available.

The advisory output is a defensible category and role decision, a dated article-by-article gap map, and an ordered plan for conformity assessment, producer responsibilities and future data duties. It is not a blanket certificate or a guarantee of EU market access.

First decision: classify the battery, the operator and the transaction

Start with a model-by-model fact sheet. Do not classify solely by chemistry, weight, the product’s marketing name or an IEC test report. The Regulation distinguishes five categories and applies special rules where a battery falls within more than one category for Chapter II.

  • Battery facts: intended application, standalone or built-in use, chemistry, rechargeability, capacity in kWh, dimensions, battery management system and whether it is portable, SLI, LMT, EV or industrial.
  • Product and transaction: drawings and model identifiers; who designs, brands, manufactures, imports, first supplies in each Member State or sells remotely; when each model is first placed on the market.
  • Regulatory roles: identify the battery manufacturer, importer, distributor and the ‘producer’ for extended producer responsibility separately. One company may hold several roles; a supplier’s CE mark does not transfer all duties.
  • Evidence already held: EU declaration of conformity, technical file, test reports, substance declarations, supplier identity, traceability records, label artwork and any life-cycle data, with model and revision numbers.
  • Change triggers: new cell supplier, altered chemistry or capacity, repackaging, own-brand sale, refurbishment, a new target Member State or a new implementing/delegated act.

Route matrix: which decision comes before commissioning work?

Use this as a routing screen, not a claim that every obligation is already applicable. Confirm the version of each implementing or delegated measure at the decision date.

Gate / battery situation Legal route to verify Next safe decision
All battery categoriesArticles 6, 13 and 17–20: applicable substance, information, conformity assessment, EU declaration and CE-marking duties. Article 17 and Annex VIII distinguish Module A from D1/G routes.Classify the exact requirements first; do not assume a notified body is always required.
Battery integrated into an applianceArticle 11: removability and replaceability rules generally apply from 18 February 2027, subject to specific conditions and derogations. The Commission adopted additional proposed derogations in July 2026; confirm their final legal status.Check product function, safety rationale and applicable exception before redesign.
EV; LMT; industrial battery >2 kWhArticle 77: battery passport from 18 February 2027 for these categories; Annex XIII differentiates public, restricted and battery-specific information.Identify the data owner, unique identifier and access rights before procuring a passport platform.
Carbon-footprint / recycled-content workstreamArticles 7–8 apply to defined categories and dates, with conditions tied to secondary measures; Article 17 can require D1/G for these requirements.Check model category and applicable acts before commissioning LCA or notified-body work.
First supply in a Member StateArticles 3(47), 55–56: determine who is the producer for each market and whether registration and extended producer responsibility apply, including batteries inside products.Map selling countries and responsible entities; do not treat CE marking as producer registration.
Responsible sourcing and due diligenceArticles 47–52: application postponed to 18 August 2027 by Regulation (EU) 2025/1561; Article 47 has a net-turnover/group test and a specific second-life exception.Validate eligibility, group turnover, raw-material flows and a feasible verification plan without claiming every seller is in scope.

Evidence-reuse test: what can be carried forward?

Reuse is conditional. A passed test, supplier declaration or certificate is an input to a documented assessment, not automatic proof for another model, legal article or production site.

Existing material Reuse condition Gap / stop sign
Battery test reportExact model, chemistry, design revision, test method and relevant regulatory requirement match.Unclear traceability, changed cell or report addressing only transport safety.
Supplier technical file or EU declarationObtain adequate underlying evidence and determine your own manufacturer/importer duties.Brand or design change, no access to test basis, missing applicable article.
Carbon or recycled-content datasetCheck site, product model, boundary, methodology and applicable secondary acts.Generic corporate figures or a dataset for another manufacturing plant.
Passport-ready dataMap Annex XIII fields, source system, identifier, update owner and access level.A QR code without reliable, maintainable underlying information.
Due-diligence policies and auditsConfirm raw materials, supply-chain coverage, legal entity and Article 47 scope.General ESG policy offered as automatic evidence of Article 48–52 compliance.

Advisory sequence and decision record

  1. Freeze the model/SKU list and markets; collect a one-page fact sheet and revision-controlled evidence index.
  2. Write a reasoned classification and role memo, recording unresolved facts and why alternative categories or exclusions were rejected.
  3. Prepare a dated applicability matrix: article, trigger, evidence status (usable / conditional / missing), accountable entity, priority and source.
  4. Separate immediate market-access blockers from future obligations and items awaiting secondary rules; identify tasks that should not be ordered yet.
  5. Choose next actions: request missing supplier evidence, obtain targeted technical or legal advice, select the correct assessment module and only then scope laboratory or notified-body engagement.
  6. Set change-control triggers and a review owner; re-open the memo when a model, supplier, law, role or sales territory changes.

A decision is ready for execution only when the category, responsible party, applicable version of the rule and evidential basis are recorded. An unresolved fact belongs in the risk register, not in an unqualified declaration of conformity.

What belongs to a consultant—and what belongs elsewhere?

This page owns the pre-execution classification, evidence triage and sequencing decision. Detailed filing, testing, declarations and operational delivery belong under EU Battery Regulation compliance services. Project prices, cost drivers and budgeting belong under EU Battery Regulation compliance cost. Neither link replaces the legal classification for your particular battery and transaction.

Frequently asked strategic questions

Can I use a supplier’s CE declaration for my own-brand battery?
It is useful evidence, but own-branding or modifying a product can change the manufacturer analysis. Verify which entity is legally the manufacturer, whether the model is identical and whether the supporting technical file covers all applicable requirements before relying on it.
Does an industrial battery of exactly 2 kWh need the Article 77 passport?
The industrial-battery passport threshold is greater than 2 kWh, not 2 kWh or greater. Other categories, including EV and LMT, have separate coverage; other labelling and documentation duties may still apply.
Should I commission a carbon-footprint study now?
First check category, production site, the applicable Article 7 phase and the status of relevant secondary acts. Commissioning a method or verification process before this check may produce unusable or premature evidence.
Are battery due-diligence checks already mandatory in October 2026?
The battery-specific Chapter VII obligations are scheduled to apply from 18 August 2027 following Regulation (EU) 2025/1561. Article 47’s net-turnover/group test and the second-life exclusion matter; unrelated applicable supply-chain laws must be considered separately.
If a battery is inside a wearable device, must the user replace it?
Do not infer an exemption from the word “wearable.” Article 11 has specific derogations; the Commission’s July 2026 additional derogation measure required legislative scrutiny and publication. Verify its current legal status and the device’s exact characteristics before deciding who must be able to replace the battery.
