Regulatory guidance and project coordination

Eu Packaging Ppwr Compliance Services

Scope and evidence must be confirmed before any paid tests or filings.

EU packaging PPWR compliance services should turn a mixed packaging portfolio into a controlled release decision, not merely supply a certificate. Regulation (EU) 2025/40 generally applies from 12 August 2026; the dates of specific design, labelling, recycled-content and reuse measures differ and may depend on further EU acts.

A workable engagement coordinates legal classification, packaging specifications, supplier evidence, proportionate verification, conformity documents, national EPR actions and change management. The output is a traceable record for each packaging type and each target market—not a promise of automatic approval.

Scope, packaging map and accountable operator

At intake, identify empty and filled packaging, all components, materials, intended contact (especially food), sales/grouped/transport/e-commerce function, single-use or reusable design, SKU-to-packaging-type mapping, first EU placement date and destination Member States. A component or co-packer change can alter the evidence needed.

Assign roles separately for the packaging manufacturer under Articles 15–16, any importer or distributor, the supplier providing data, and the producer responsible for national EPR. The brand owner is not automatically the manufacturer in every arrangement; apply the Regulation’s definitions and special cases, including its micro-enterprise provision, to the actual contracts and supply chain.

For own-brand or private-label packaging, first test whether the operator commissioning the design or manufacture under its name or trademark is the manufacturer, even if a converter physically makes the pack. Article 15(12) reallocates that role to an EU-based supplier in the stated micro-enterprise case. Record the legal basis and contracts; do not infer the role from who pays for testing.

Before fixing the signer, also apply Article 21: an importer or distributor selling packaging under its own name/trademark, or modifying it in a way that could affect compliance, may take on the manufacturer's Article 15 duties; Article 21 has its own limited micro-enterprise rule. Check the narrow Article 15(11) exception: paragraphs 2 and 3 (assessment/documentation/declaration and retention) do not apply to custom-made transport packaging for configurable medical devices and medical systems used in industrial and healthcare environments. This does not exempt such packaging from every other applicable PPWR rule.

PPWR six-gate execution: packaging intake to market release

Use a six-gate work order with an owner, inputs, decision and sign-off for each packaging family:

  1. Intake and responsibility lock: obtain BOM, drawings, packaging weights, suppliers, brands, food-contact statements, purchase flows and destination countries; name the lawful signatory and EPR lead.
  2. Requirement-by-date map: separate duties applicable now from later milestones, conditional implementing acts and national EPR rules. Record any unresolved classification as an explicit hold.
  3. Supplier evidence request: obtain material/coating/adhesive declarations, relevant existing results and production controls; link every file to a material revision and packaging ID.
  4. Verification brief: choose component samples and analytes by risk; commission competent laboratory work or engineering assessments where supplier evidence does not adequately substantiate compliance.
  5. Technical file and country workflow: resolve failures or redesign, compile Annex VII evidence, prepare the Annex VIII EU declaration for manufacturer approval, and complete required national EPR registration/reporting steps on applicable portals.
  6. Release and maintenance: check that signed documents match the sold configuration and destinations; archive evidence and create retest/reassessment triggers for future changes.

PPWR substances and recyclability: evidence and laboratory routes

Do not order a universal “PPWR test”. Select the evidence route against the applicable rule and the actual material:

Packaging signalEvidence route / handoffDo not conclude
All packaging and components, including undecorated materialsCheck supplier chemistry and combined Pb/Cd/Hg/Cr(VI) evidence; commission relevant chemical analysis if insufficient (Art. 5).A supplier brochure alone proves composition of every component.
Food-contact paper, fibre, film or coated packagingReview existing food-contact dossier; assess Article 5 PFAS limits and commission suitable targeted/total-fluorine work where risk warrants.A total-fluorine screening result alone conclusively quantifies PFAS.
Plastic or mixed-material packagingCapture composition and recycling-design data now; plan later recyclability/recycled-content assessment against applicable adopted methodologies.Provisional recyclability scores are a final legal 2030 grade.
Reusable, compostable or transport/e-commerce designVerify reuse-system claims, intended use and relevant future minimisation/empty-space/compostability duties; document test or engineering assumptions.Every 2030 duty already applies in 2026.

A laboratory report is evidence, not by itself an EU declaration or a blanket PPWR certificate. The PPWR conformity route for Articles 5–12 is Annex VII Module A (internal production control); do not imply compulsory notified-body certification solely under the PPWR.

For food-contact packaging, Article 5(5) sets three separate limits from 12 August 2026: 25 ppb for an individually targeted PFAS, 250 ppb for the sum of targeted PFAS and 50 ppm for PFAS including polymers, with the statutory measurement qualifications. Where total fluorine exceeds 50 mg/kg, the Regulation provides for requested evidence separating fluorine in PFAS from non-PFAS. The Commission’s 2026 guidance recommends a staged analytical approach, not one mandatory laboratory method for every pack.

Do not defer all recyclability work until 2030: the general recyclability condition in Article 6(1) applies from 12 August 2026, as clarified by Commission guidance. The later mandatory design-for-recycling grades/criteria have their own conditional start dates and delegated-act dependencies. Document the present Article 6(1) assessment and separately flag a future-grade forecast as provisional.

Annex VII technical file and EU declaration

The manufacturer’s technical documentation under Annex VII must describe the packaging and use, design and components, applicable requirements, risk analysis, specifications or standards used, and assessment/calculation/test records as relevant. Article 16 obliges suppliers to give manufacturers the information needed to demonstrate compliance. Cross-reference reports to the exact packaging variant rather than leaving unindexed PDFs.

After Annex VII assessment demonstrates compliance with the requirements applicable at that time, the manufacturer draws up and maintains an EU declaration following Annex VIII (Articles 15, 38–39). The declaration is the manufacturer’s responsibility, not the consultant’s or laboratory’s. Retention under Article 15 is five years for single-use and ten years for reusable packaging after placement; required language(s) depend on the Member State. There is no general EU PPWR portal on which this declaration is routinely “filed” for pre-approval; it must be available to authorities.

National EPR: filings are not the EU declaration

Treat EPR as a separate, country-by-country data and filing workstream. Identify the producer in each destination country, measure relevant packaging amounts, check the register and producer responsibility organisation, determine authorised-representative needs, and assign periodic reporting. Registration proofs belong in the operational launch pack; they are not a replacement for Annex VII/VIII conformity documents.

The Commission notes that existing national EPR registration rules continue while harmonised registers and reporting formats develop under Article 44. Small-business arrangements and the cross-border EPR representative rules require a current country-specific check; a Commission proposal concerning small businesses is not itself enacted law. Do not promise one EU-wide registration, uniform fees or a fixed processing time.

For cross-border direct-to-end-user supply, decide first whether the entity is a 'producer' within Article 3(1)(15)(c) or (d). Article 45(3) requires that producer to appoint an EPR authorised representative by written mandate in each relevant Member State other than its Member State of establishment; Member States may additionally require representation by certain third-country producers. This EPR representative is a different legal role from an optional manufacturer's authorised representative under Article 17. Record the specific trigger and mandate country by country; do not treat the Commission's proposed suspension as law.

PPWR launch holds: packaging identity, proof, EPR and revisions

Apply four decision gates before authorising supply:

  • IDENTITY: packaging ID, BOM, drawings and sample/report revision match the goods being supplied.
  • LEGAL TIMING: each applicable obligation is marked effective now, deferred or awaiting an EU act, with source and owner.
  • EVIDENCE: missing supplier chemistry, ambiguous PFAS screening, outdated tests and failed values create a documented hold.
  • COUNTRY: destination-language requirements and current national EPR/representation steps are checked.

On changes to resin, ink, adhesive, contact use, manufacturing site, supplier, packaging dimensions, reuse claim or destinations, reassess whether the conformity procedure, test scope, declaration and EPR dataset need updating. Record hold → correction → repeat verification → approval; a “passed” 2026 file is not a permanent exemption from future rules.

Check physical traceability before release: under Article 15(5)–(6), packaging identification and the manufacturer’s name/contact particulars must be provided through the routes the provisions permit. The Commission’s August 2026 FAQ discusses an accompanying-document approach for certain stock manufactured before 12 August 2026; this is not a blanket exemption for that stock from PFAS, conformity documentation or other applicable requirements. Log manufacture date, first EU placing-on-market date and the specific justification for any alternative marking route.

Apply three separate stock paths: (1) packaging already placed on the EU market before 12 August 2026 may remain there under the Commission FAQ; (2) packaging manufactured before that date but not yet placed on the market may use an accompanying document for the Article 15(5)–(6) particulars under that FAQ, but other applicable requirements still need assessment; (3) for packaging manufactured after that date, an accompanying document is permitted only within the statutory conditions where marking the packaging is not possible. A manufacture date by itself does not prove an earlier placing-on-the-market date.

At artwork approval, distinguish current restrictions on misleading packaging symbols/claims under Article 12(8) from later harmonised material labels under Article 12(1). Do not approve a label simply because its future EU pictogram specification is still being developed.

Where the PPWR service stops

Packaging conformity is not the same as product safety certification or a CE mark. For chemical obligations affecting the contents or articles, follow EU REACH compliance services, EU product compliance and market-access services, CE marking services.

Operational PPWR questions

Can a supplier’s statement replace every laboratory test?

Not automatically. Check relevance, traceability, method and risk. Annex VII calls for an adequate conformity assessment, not a universal compulsory test package; an unsupported material claim should remain unresolved until verified.

Do we send the EU declaration to an EU authority before each launch?

The manufacturer draws up and keeps the declaration and technical file, providing them when required. Do not confuse this with separate Member-State EPR registrations and reports; there is no general routine EU pre-approval filing for the PPWR declaration.

What if food-contact packaging passes heavy-metal analysis but PFAS data are missing?

Treat food-contact PFAS as a separate Article 5(5) question from 12 August 2026. Obtain suitable formulation and analytical evidence, assess the legal thresholds, and withhold a positive sign-off until the gap is closed.

Can a 2026 recyclability estimate clear our 2030 packaging?

No final guarantee. Preserve the design inputs and monitor delegated design-for-recycling criteria, recycled-at-scale methodology and any applicable exceptions before asserting compliance with later dates.

Can one EU technical file cover a family of packaging?

Evidence can be organised by justified packaging type or controlled family only where differences do not defeat the assessment. Keep unique traceability, variant boundaries, test applicability and signed declaration identification; revisit on any material or supplier change.

Official legal and implementation sources

Primary legal authority is the Regulation; the Commission guidance and implementation pages explain operational questions but do not replace binding text. Verify subsequent implementing/delegated acts and each national EPR system before release.
