Australia Tga Medical Device Registration Sponsor Service

Scope and evidence must be confirmed before any paid tests or filings.

An Australian TGA medical device sponsor is the eligible Australia-based person or business responsible for the device’s supply and the regulatory relationship with the Therapeutic Goods Administration (TGA). A marketing agent or adviser is not automatically its sponsor.

An overseas manufacturer normally needs an Australian sponsor. For a device that is not exempt or excluded, the relevant Australian Register of Therapeutic Goods (ARTG) inclusion must be in place before lawful supply. Sponsorship does not itself certify a device.

Who can be the Australian sponsor?

The sponsor must satisfy the Australian eligibility and presence requirements and actually undertake the relevant import, export or supply responsibility. Australian manufacturers may also act as sponsors; an overseas manufacturer needs an Australian party. A distributor can be a sponsor, but its sales contract alone does not settle the regulatory role.

Identify the legal sponsor, the importer, the manufacturer and any downstream distributors separately. Determine who will control the ARTG entry, receive TGA notices and retain access to evidence if the sales relationship ends.

Manufacturer–sponsor responsibility matrix

The manufacturer and sponsor cooperate, but neither should assume that outsourcing administration removes its own regulatory duties. The following division is an operational planning tool, not a substitute for the legislation or an individual agreement.

Appointment: agree access, authority and handover

Before appointing a third-party sponsor, use a written manufacturer–sponsor arrangement that permits timely regulator responses. The items below are recommended contract controls, not a claimed TGA-prescribed contract template.

  • Identify both legal entities, device kinds, covered products and the importer/distributor chain.
  • Specify who maintains manufacturer evidence, conformity documents, technical files and English translations; set access and response channels.
  • Assign TGA Business Services access, submission approval, fees and authority to answer official requests.
  • Define complaint intake, incident escalation, overseas safety alerts, recalls and urgent contacts.
  • Approve sponsor-name/address placement on device, packaging or leaflet, as applicable, and changes to artwork.
  • Set audit cooperation, secure records, confidentiality, termination, continuity and transition assistance.

Practical workflow from appointment to supply

The sponsor-service handoff should follow these gates; substantive classification and assessment are separate tasks.

  1. Confirm the device’s intended purpose, Australian classification and whether an exclusion or exemption applies.
  2. Verify the sponsor’s Australian status; execute information-access and incident-reporting arrangements.
  3. Complete the applicable manufacturer-evidence and ARTG application route through TGA Business Services; do not treat an application as approval.
  4. Once the relevant supply authorisation is in place, verify sponsor identification and activate traceability, vigilance and change-control processes.

Ongoing controls: identity, records and safety

Under regulation 10.2, the sponsor’s name and address must accompany devices supplied in Australia in a way users can readily identify. Placement depends on practicability: device, packaging or supplied leaflet. This is distinct from the manufacturer’s identification requirements.

The sponsor must monitor complaints and adverse events, communicate with the TGA and keep distribution records for traceability. The TGA specifies at least 10 years for Class III, Class 4 IVD and implantable Class IIb distribution records, and 5 years for other classes; other record categories may have different retention rules.

Changing sponsor: transfer or new inclusion?

An ARTG entry is tied to the sponsor, manufacturer and kind of device. If the commercial partner changes, assess whether the current sponsor will lawfully transfer its ARTG interest to a new eligible sponsor, or whether the new party must obtain a separate inclusion.

A manufacturer cannot simply reassign another sponsor’s ARTG entry by filing a form when the distributor changes; there must be a legally valid change-of-sponsorship event. The new sponsor must notify the TGA within the applicable period (TGA guidance specifies three months from the event) and provide supporting evidence where required. Both sponsors normally sign a transfer notification, but the TGA may accept alternative evidence in exceptional circumstances if the former sponsor cannot sign. Align the record, labelling, distribution traceability and open safety cases before switching supply.

Limits of a sponsor service and next decisions

Sponsor appointment does not prove that a device meets the Essential Principles, replace manufacturer conformity evidence, guarantee inclusion, or automatically cover another importer’s ARTG responsibilities. Exemptions and special access routes require their own eligibility check.

Questions about Australian TGA sponsorship

Can a foreign manufacturer appoint only a consultant overseas?

No. An overseas adviser may help prepare documents, but the legally responsible sponsor must meet Australian sponsor requirements. Confirm the named Australian entity and its actual role.

Can two Australian importers use the same sponsor’s ARTG entry?

Not simply because the device and manufacturer are identical. Separate sponsors generally require their own entries; downstream distribution under an existing sponsor must be distinguished from independent importation as a sponsor.

Does CE certification or US FDA clearance eliminate the sponsor?

No. Overseas evidence may be relevant to the Australian application, but it does not itself replace the Australian sponsor or the applicable ARTG pathway.

Must the sponsor own the complete technical file?

Not necessarily. The manufacturer ordinarily maintains the technical evidence; the sponsor must have reliable procedures and agreement-based access to obtain what the TGA requests.

Can the manufacturer simply move the ARTG listing to a new distributor?

No unilateral reassignment merely because a new distributor is chosen. A lawful transfer normally involves both sponsors and TGA notification; exceptionally, the TGA may accept other evidence if the former sponsor cannot sign. Otherwise the new sponsor may need its own application. Preserve labelling and safety continuity.
