Product Compliance And Market Access Services In Germany

Scope and evidence must be confirmed before any paid tests or filings.

Germany is an EU single-market destination, but there is no single “German product certificate” that unlocks every category. First classify the product under applicable EU or national rules; then check the additional German market-entry obligations that attach to the seller, packaging or waste stream.

This Germany market hub is a route selector, not a substitute for a product-specific legal assessment. A CE mark, a laboratory report and an environmental registration answer different questions; none alone proves that an offer may go live.

Choose the legal route by product and use

Start with function, intended users (including children), power supply, radio functions, composition, safety claims and the exact configuration sold. Combined products can trigger several regimes at once.

Product signal Likely first route to assess Important boundary
Machinery or industrial equipment EU machinery framework, plus other applicable electrical/EMC rules Check the applicable regime on the placement date; Regulation (EU) 2023/1230 generally applies from 20 January 2027.
Radio-enabled electrical device Radio Equipment Directive and other relevant EU requirements CE assessment is separate from German WEEE, battery and packaging duties.
Toy or protective equipment Toy or personal protective equipment sector rules A notified body is required only where the applicable conformity-assessment route says so.
Furniture, clothing or ordinary consumer article General Product Safety Regulation (where in scope), chemical and relevant labelling rules Do not affix CE merely because the product is sold in the EU.
Food, cosmetics or medical product Dedicated sector regime and competent authority Do not assume the ordinary consumer-goods or CE route applies across the category.
Any packaged product shipped to Germany Assess packaging producer status and PPWR/VerpackDG duties Packaging compliance does not replace the product's safety route.

This is triage, not a classification ruling. Resolve borderline definitions, intended use and applicable transition rules before commissioning tests or printing a CE mark.

Identify the responsible economic operator

Identify who controls the design/brand, who first imports from outside the EU and who offers the product. These roles may differ by legal regime.

Commercial model Primary question Safe action
Own-label or private-label sale Are you the legal manufacturer even if another factory makes it? Obtain the complete technical file and determine who signs declarations where required.
First import from outside the EU Who is the EU importer and what must it verify? Check the manufacturer's assessment, identity, instructions, traceability and available evidence before placing on the market.
Resale of EU-sourced stock Does the distributor have evidence of the supplier and compliant presentation? Verify source, markings and warnings; rebranding can change the role.
Direct online sales from abroad Which EU responsible-person rules and separate German EPR representation duties apply? Assess GPSR/market-surveillance economic-operator rules and packaging, WEEE and battery appointments separately.

A German authorised representative for WEEE or packaging is not automatically the EU economic operator required under product-safety legislation; mandates and legal tasks are distinct.

Apply the German obligations in parallel

The same physical device may clear EU product conformity while still lacking required German registrations or consumer-facing information:

  • Market surveillance: authorities of the German Länder enforce many ProdSG-covered product rules; BAuA supports coordination and publishes safety notices. Sector regulators may differ.
  • Packaging: since 12 August 2026, PPWR and the German VerpackDG govern the framework. Determine the packaging “manufacturer” separately from the EPR “producer”; where applicable, complete LUCID registration, system participation and volume reporting. Foreign businesses without a German branch that sell packaged products or empty packaging directly to end users in Germany must appoint a Germany-based authorised representative for packaging EPR; they must still register themselves in LUCID.
  • Electrical goods and batteries: determine whether ElektroG or battery registration applies. Relevant producers must secure the applicable stiftung ear registration before placing covered goods on the German market; foreign producers without a German establishment may need a German authorised representative.
  • Market presentation: verify German-language instructions and warnings when required by the relevant regime, product/actor identification, online-offer information, and any sector-specific labels. Do not infer that CE or an EU test report replaces these checks.

Sequence the launch: six release gates

Use an ordered release checklist rather than ordering tests and registrations randomly:

  1. Freeze the model, intended use, customer group, radio/battery configuration and proposed claims; flag borderline sector classifications.
  2. Map all applicable EU product regimes, including any GPSR residual safety coverage, and decide whether CE or a notified body is actually required.
  3. Name the manufacturer, importer, distributor and any necessary EU-based economic operator; document who owns the technical evidence.
  4. Complete the applicable conformity assessment, risk documentation, declarations and product markings before market placement.
  5. In parallel, determine PPWR/LUCID, WEEE and battery obligations by supply chain, brand and product category; complete applicable registrations/appointments.
  6. Validate German listing and instructions, release the correct SKU, retain evidence and monitor incidents, recalls and changes.

Prepare a traceable decision file

For each SKU, keep a concise route memorandum with these evidence groups:

  • Product identity: photographs, model/variants, BOM, intended users, marketing claims, radio modules and batteries.
  • Rule map: each applicable instrument, scope reasoning, exclusions, transition dates, assessment route and accountable entity.
  • Safety proof: risk analysis, relevant tests and standards, technical documentation and signed EU declaration where required; a supplier certificate alone may not suffice.
  • Germany overlay: packaging unit/material weights, LUCID/system evidence where relevant, ear registration identifiers and authorised-representative mandates where needed.
  • Launch pack: importer/manufacturer contact details, German safety text where required, packaging/listing screenshots and traceable supplier agreements.

Re-open classification and evidence after a radio/firmware function change, replacement of a critical component, new battery chemistry, rebranding, a new direct-sales chain, a changed claim or a regulatory transition. A cleared prototype is not automatically every future variant.

Choose the next specialist route

For EU-wide conformity architecture consult the EU market-access hub; for expansion beyond the EU use the global hub. Product-specific compliance must still be assessed under the applicable sector rules; a general market hub does not replace that assessment. A France or Poland hub is useful only when those markets are also planned.

For a first triage, provide a product photograph/specification, intended use and user age, brand ownership, country of dispatch, Germany delivery model and whether the item contains radio equipment, electrical parts or batteries. Those facts determine which specialist assessment comes next.

Official starting points (verify category-specific provisions)

Practical questions before selling in Germany

Is a CE-marked imported electronic gadget ready to sell in Germany?

Not on that evidence alone. Confirm the correct CE legislation and importer responsibilities, then check electrical-equipment registration, battery duties, packaging producer status and German-facing information; applicability depends on the actual device and selling model.

Does every consumer product need a German licence or a CE mark?

No. CE applies only to categories covered by legislation requiring it, and affixing it outside that scope is prohibited. Some products instead require GPSR risk controls or other sector rules; EPR registration is a separate question.

Can an item already sold in another EU country be listed in Germany unchanged?

Not automatically. EU harmonised product rules may support circulation, but packaging EPR, WEEE/battery responsibilities, language and online-offer obligations must be reviewed for the German supply chain. Non-harmonised goods may call for a mutual-recognition analysis.

Can one authorised representative cover product safety, packaging and WEEE automatically?

No. EU product-safety economic-operator requirements, German packaging EPR representation and stiftung ear mandates have different triggers and tasks. Check each independently and appoint/record the legally appropriate actor.

What if the product includes both a rechargeable battery and a wireless module?

Run parallel assessments: radio-product conformity and any other applicable electrical restrictions, plus ElektroG, batteries and packaging. Collect the radio/module data, battery category and chemistry, brand, supplier evidence and fulfilment route before launch.
